cavity wall insulation GFF legal advice

Hi
My nan and grandad live in and own a GFF. They own the free hold as well. They desperately need cavity wall insulation but unfortunately the man who owns the upstairs flat will not cooperate. He rents the flat out, refuses to pay any ground rent and even though my nan and grandad are willing to pay for the insulation for the whole building he will not give his permission.
I was wondering if anyone knew if they were legally entitled to go ahead without his permission.

If you own the freehold then you can do any maintenance work like this, I don't even believe that notice has to be given for works like this to the building structure (unless it chargable under the leasehold agreement).
All the same best get quick confirmation from a legal advisor.
Also ensure that the contractor is fully insured as if the person resisting the work acts up they may say that the works outside has caused internal damage (like cracks that were already there).
Also as the freeholder you need to set and enforce the rates payable by leaseholders and enforce it with legal action if not paid.0
