With friends like this who needs enemies

hi folks, what a cr*p week im having. Anyway monday morning i got a letter from huddersfield magistrates court, relating to a fine to the total of £185 , now I m from birmingham I dont even know where huddersfield is let alone ever been there. I phoned the court and they told me that on 5th december 2005 i incurred fines related to an offence of driving. I was told that I did not attend court on the 24 th march 2006 and I was convicted in my absence. Now i was thinking that this was some sort of joke, but it turns out it was not. I asked where they got my details from and aparently they can search a central database and got my name as it was given as the owner of a car, now I drive a company vehicle and any fines go through head office as the car is not registered in my name.
I was told that i have recently moved address from , then she gave me the road name which i recognised it as a friend mothers address, it turns out this friend had given my name as been the registerd keeper of a car , which had then been sold on and then car related offences all in my name. I have confronted the person in question who has admitted it saying that im the most law abiding person that she knows, but anyway i contacted my local court and i have sworn a statutory declaration in my local court yesterday saying that i had no knowledge of the offences. Now my friend (ex) has said that the baliffs had come to her mums address to seize goods, now although i attended court yesterday, i have been told that now that they have my correct address the baliffs will attempt to come to get stuff from my home, and that it will affect my credit rating as i will now have ccj's against my name. im a absolutely fuming and ive just cried for the last few days as everywher i have turned have just fobbed me off. The police have told me that no criminal offence has been committed, im at my wits end. I was supposed to be having a nice relaxing week as its my birthday on friday but all i seem to be doing is trying to sort out this sh*t. anyone any ideas.

  • Awww; I'm afraid that I don't know much about how to help your predicament, but wanted to say that I hope your week gets better so you have a good birthday.

    It's sod's law that these things happen, what a b***h your ex friend is.

    Not really able to offer any advice, but you have my best wishes for the future.

    Might be worth going to the CAB and getting some advice from them? Or pop into a local solicitor and get a free first interview.

    It seems strange that there's no criminal offence - surely giving a false name to the police is criminal?

    deception with intent to pecure an advantage.

    Giving false details when required to do so??

    I think you need to CAB/legal help.

    You have been dropped in it by a "friend" and now the system has swung into action, it will take proper help to stop this.

    Get onto the CAB right away, explain everything as you have done here.
    I am sure you will get the help you need there.

    You have done nothing wrong - remember that. Keep strong.

    If you feel like the whole system is against you, you could try your local MP - you can email most of them now through the theyworkforyou (?) website.

    I tried it for something a lot less serious and was suprised to actually get a personal response from both my MP and MEP.

    Surely this is akin to stealing your identity. Can you not go to the police?

    I would say that your friend has commited a criminal offence. In Scotland it would be classed as Attempting to Pervert the Course of Justice' which is a crime at common law,not applicable in England, but I am sure there will be an equal statutory offence in England.
    I would most definately seek advice from a soliciter, if you are unemployed or on a low income you may be entitled to legal aid. Failing that try. CAB.

    Thanks i didnt even think about this, i guess im just expecting a load more of stuff that shes done in my name, and i feel that no one wants to help me the court and the police are just been so unhelpful.:mad:
