Santander fraud help

I'm posting this for my sister who is looking for advice on a problem with santander.


In January she had a payment of £300 taken out her account to a company called LUK(they make clutches) she did not make this payment and nor did her boyfriend, this payment taken the account overdrawn.

When she contacted santander they gave her a disclaimer to fill out which she did and sent off, after 3 weeks she phoned them and the answer she was given was there isn't enough evidence. They also gave her the contact details of LUK which she phone but this company would not provide details about what was ordered or where it was shipped to.

After this she stopped using the account and opened up another bank account while they tried to sort it out but Santander will do nothing but apply bank charges to the account.

Here is the funny part, the bank account had all payments stopped on it for suspected fraud and this company tried to take payment all through December 2010 before getting the payment in January 2011.

£300 is quite a substantial amount of money and add loads of charges (£200+) my sister has a child and money is tight as it is.

What can she do?

    By the sound of it the bank have acepted that she is the victim of fraud and they onbviously do not have concerns that she was negligent and therefore opened herself up to fraud (i.e. keeping your pin number with your card).

    The bank has a legal obligation to reimburse the money that was fraudulently taken from her account minus £50 which she will be potentially liable for.

    She should refer this to the Financial Services Ombudsman immediately.

    Santander must have a reason as to why they won't take this on as fraud. Your sister needs to ask them what evidence they have to confirm this. They can't just say that they won't refund. Is there maybe something your sister isn't telling you ? It's odd to open another bank account just because you have fraud on another.

    It's hardly odd, most of us need a bank account for our everyday financial transactions. There are many posts on here advising the opening of a second account before you have a problem. Frankly, for anybody dealing with Santander, I'd say it was a necessity.

    The reason i said it was odd is that it's usually just the card which is compromised, not account details so it's not really necessary to close an account because of fraud.
