Hello,
Can anyone help me?
I am just trying to work out if myself or partner would be entitled to any help. We currently live 40 miles apart and have a 4 year old daughter. We have never lived together as we could not afford to do so. I am being evitced from my property in 3 weeks as my landlady is selling. Our little girl wants to move and live with Mummy and Daddy but I currently do not work.
He has a council house (rent approx £90.00 per week) and works 43 hous per week. He earns roughly £25000 per year and pays csa for he's son from past mariage.
Our concern is that we would not beable to make ends met if I was to move with my daughter. I have not worked since having her as I had no one to look after her. I would like to look for work in September, when she starts full time school so am not work shy!!!
I actually want a job.
My problem is my local council, they paid my bond for me on my property and will not allow me to move out in 3 weeks (onc my tennacny ends!) They have told me I have to sit tight until my landlady takes me to court and I receive a letter from the baliffs. This I have been told could take upto Sept (which is when my daughter is due to start school)
I don't want to sit and wait until Sept and then have to move my daughter from school (after starting for the first time for maybe a few days) I want her to start school and not have to move as this is a big thing for children as it is and she may have trouble settling into 2 different schools within a few weeks.
So my worry is, do I up and move and hope that we get some help while I look for a job or do I stay where I am and just wait to see if my council wll help?
I have been told I could also be liable for court costs for my landlady taking me to court (although I do not want this, I just want to move, its not my choice)
Does anyone know if me and my partner would be entitled to any help as this is the decieding factor in my making my choice?
I am worried that if I move we would not cope finacially.
I have tried doing online calcs but one says we would not get any help and another says we would so I am confused.
Sorry for the long eassy.......Just wanted to cover everything.
Any help would be great as I am currently so stressed and worried that I am not sleeping and making myself ill!

    If 'money' is the deciding factor on whether or not you move in with your partner, then right off the bat, I'd say you'd be setting yourself up for problems if you moved in. Reason? Money might be okay at first, what happens if that situation changes - he loses hours at work, loses his job etc......then the monetary situation can always change and be worse - meaning what? That you wouldn't want to be with him? Although finances are important - having your child in a loving stable home is much more important - and whether that is with you alone, or with both of you as a family - is what you need to decide will be better for your child.

    But.....you refer to him as your 'partner'.....yet you both sound like you are claiming as 'single' people - and choosing to live apart as you get more financial help by being singles.

    If you want to be together as a family - his income is enough to provide for the three of you plus previous child - maybe what you really need is some financial help on how to live more frugally, and how to cut down debt if debt is an issue for one or both of you.

    It is your choice whether to force your landlady to evict you. You don't have to get your landlady to evict you if you want private accommodation, only if you want council housing. Do bear in mind that if you rely on the council rehousing you, they may not rehouse you where you want to live, and like you say, you could be liable for court costs.

    I'll say nothing about the issue of whether you should be claiming as a single person when you are part of a couple living apart (as opposed to separated) except to strongly urge you to get advice on your legal position.

    There are families who manage on a lot less than £25K. BTW, has he been paying you child maintenance for the last 4 years?
