Renting question

Afternoon all my tenancy is up on the 15 august if my LL wanted me to leave could they give me notice on the 15 June for two months notice or would it have to be on the 15 of august .

    15 June for two months notice, unless the tenancy agreement says different and possibly depending on what day your rent is due.

    However even if they do, you do not have to move out until they have a court order granting them possession, and if they try to get you out without that court order they may be guilty of tenant harassment. Contact Shelter if you are worried about your tenancy.

    If your tenancy ends on 15th August then that is the day you should leave - no notice required. If however, it say that it will become a periodic tenancy then your landlord needs to give two months' notice (or you need to give one).

    No need to panic or call shelter or get nasty. Contact your landlord and ask him what happens next. I'm surprised he hasn't vcontacted you first but there is plenty of time.

    You will probably end up paying the landlord's Court costs.

    Assuming you have an assured shorthold tenancy in England/Wales, with a fixed term expiring 15th August 2011, the LL may serve a s.21 notice at any time up to and including 15th August; it must give you at least two months and cannot expire before the end of the fixed term (it doesn't have to expire at the end of a tenancy period).

    If you remain in occupation after 15th August and do not sign a renewal contract, the tenancy will be become periodic as from 16th August. Same terms as the existing contract except for any provisions relating to notice. A s.21 served in a periodic tenancy is slightly different; it would have to give you at least two months and also expire at the end of a tenancy period.

    A s.21 notice is not a notice to quit; it does not end the tenancy nor oblige you to vacate. It merely entitles the LL to apply for possession after notice expiry.

    If you want to end the tenancy, you must either vacate at fixed term expiry, or, if the tenancy becomes periodic, you must give LL notice to quit.
