Being told to pay BANKS court costs!!!

Please I need help...

Received a 'general form of judgment or order' this morning from the county court stating that as I didn't attend the hearing I have to pay the defendant's costs of £90 within 14 days. When I received the original date of the hearing it stated that I didn't have to attend and there was no mention of having to pay the defendant's costs...

This 90 quid together with the costs already paid is more than the total bank charges I was trying to get back in the first place and I'm currently not working as have just had a baby.

Is anyone else in the situation and what shall I do??? Can't afford to pay the £90..???

    Have i read that right, you took the bank to court and didn't bother going?

    One assumes you lost your case. Paying some or all of the costs of the other party is a risk of court action if it doesn't go in your favour.

    1 - Did your solicitor not warn you that this could happen?

    2 - What on earth were you thinking about going to court to reclaim bank charges?

    3 - why did you not turn up? Was it because you left it to the solicitor?

    Why on earth would you take the bank to court and then not bother showing up?? What did you think would happen with the case if you didn't attend to put your arguments across? Court costs aren't guaranteed to be awarded, it is at the discretion of the judge, but I would imagine the fact that they showed up and you didn't has probably gone against you.

    £90 will be a lot less than it has actually cost the bank in terms of time.
  • I didn't go because I was told I didn't need to go and was busy having a baby.... I went the way of court action because that was the advice of Martin's website 4 years ago when I first started this whole process. Wish I hadn't bothered as it's been more stress than it's worth.

    But thanks for the really useful advice!

    Who said you didnt have to go? A solicitor? If you had a solicitor representing you then you don't as you let the legal people represent you. If you had no representative there then the person that gave you that advice let you down.

    So, when the banks won the court case two years ago and all the pending court cases were closed, why did you still proceed with yours? Especially when the advice of this website reflected that.

    Correct. Going to court is not risk free. You should contact your solicitor and ask why they didnt warn you about all this.

    Is that all they want? Doesn't seem much or is that just their costs for that day ? Will you be liable for all of the prep work etc as well?
    June challenge £100 a day £3161.63 plus £350 vouchers plus £108.37 food/shopping saving

    July challenge £50 a day. £ 1682.50/1550

    October challenge £100 a day. £385/£3100
