    There is your defence straight away, it wasn't sealed when you got it, so it's very possible the fingerprint was a member of staffs and not your sisters.

    The website T&Cs may differ from those for shop purchases. I'm fairly sure that distance selling regulations require retailers to take returns in situations which brick and mortar stores aren't.

    legally, you don't actually have a leg to stand on, I'm afraid. A store is only legally obliged to give a refund if the goods are faulty. (this does not always apply with mail/internet orders. google 'invitation to treat' for more information)

    the retailer does not actually have any legal obligation to even swap goods that are the wrong size (in the case of clothes etc, for example), or just unwanted, let alone refund you the money. even vouchers to the value should be seen as a goodwill gesture.

    However, many people still think they're entitled to a refund in cases when they're not.

    But Game does have a 10 day returns policy which is printed on the back of the receipts and on banners all over the store. This isn't so much about the legal side of it more the fact that the Co makes and advertises a promise then attempts to get out of that promise with a technicality. I hate Game, I worked for them for 3 years and they went rapidly down hill in that time, I can't imagine they have got any better since I left.
