Hi I'm new to this site & wondering if anyone out ther mite b able to help. Started my pirate tenancy 5th July 2008, seems to have been rolled over, over the last 3 years. Want to move out in middle of july this year, when should I put in my notice to quit. Was going throu paperwork today think I paid way to much before I moved in
Required to pay
£750.00 deposit paid £760.00
£750.00 rent in advance
£40.00 reference fee
£100.00 admin fee ( tenancy agreement states will be refunded in full
Total should have been £1,640
Paid £1,650 instead
For some reason I also paid
£200
£370
£380
total £950 for what I have no idea, I have receipts for all payment & have never been given the money back, I was required to pay 1month rent in advance deposit of £750, admin/ref fee
Any ideas if I can claim this back from the letting agency as they have no proof As to why this extra money was paid.
At the time of movin in I was living in a refuge & despiratly tryin to move asap , I think I prob wasn't thinking straight.
Any advice would be great x

If you have evidence of paying all this extra £950, and you really aren't sure it was lawfully demanded, write to the agent (or the LL if that was who charged you) and ask for a copy of the signed agreement to pay this amount of money. If you weren't thinking straight at the time, it's quite possible you signed something agreeing to pay 'admin fees' without realizing (in which case it'll reduce any chance of winning a claim).
However, if a contract/explanation isn't forthcoming, and you're reasonably sure the money paid wasn't owing, then write a letter before action, demanding the money by a deadline. Keep a copy of the letter and get a free certificate of posting. Say in the letter that if they don't pay up you'll bring a county court claim. You can do this online with Money Claim Online - you don't need a solicitor (but it'd be a good idea to buy/borrow a book on small claims procedure).0 -

You will need to give one month's notice to tie in with the tenancy period ( if rent paid monthly). Your Stat Periodic tenancy period began the day after the expiry of your original Fixed Term, which may or may not co-incide with a rent due date.
So, if your FT ended on, say, 4th June 2009 then each subsequent monthly period runs from 5th of one month to the 4th of the following month. Unless your LL agrees otherwise you would be obliged to pay rent etc up to the 4th August and should ensure that your notice is received by the LL by 5th July. Your LL *may* agree to a pro-rata rate up to your mid July move out if you are helpful about viewings for new Ts and they are able to re-let the property: if you want to request that you would be better off giving your notice to the LL by 5th June and discussing the possibility of staying on for a couple of weeks after 4th July. LL is however under no obligationWas going throu paperwork today think I paid way to much before I moved in
Was your tenancy deposit scheme registered by the LL and did s/he pass you the scheme's prescribed information ?0 -
Is it a private (instead of pirate) rent or through an agent?
Who provided the referencing? Agent or Landlord?
Who did you pay the extra £950 to? Agent or Landlord?Estate Agent, Web Designer & All Round Geek!0
