Hello,
just want to make it short. We bought a property , which is not on chain,back from Jan. but until now, the seller still got 2 document outstanding. we've been chasing our solicitor almost everyday, but could not make it go any further. The seller's solicitor said it is due to the delay of the local council.
the seller is selling the house for divorce. what should we do ? we really do not know if we should walk away or keep waiting.
any advice will be appreciated!

If you in fact have NOT bought, then you need to find out if this really is a council delay. Ask the seller for the date they applied to the council for searches - January is VERY unlikely. Maybe the divorcees were areguing about division of equity or something and delayed the start of conveyancing? Maybe there is another reason.
You need to put some pressure on and/or start looking again.0 -
I would send a letter to the seller's solicitor giving them a period of notice to complete outstanding items or you will walk away.I'm retiring at 55. You can but dream.0

Do you know what you are waiting for? If it is something from the council, there isn't a lot that you can do but be patient - as long as they have actually requested it from the council in the first place!
There's no point walking away unless you have somewhere to walk to. You've already spent the money by now so if you pull out, you don't actually gain anything. It is worth going back to the househunting to see if there is anything else up for sale which might actually complete sooner but bear in mind that you might meet a similar problem on the next house as well.
You need a 2-pronged attack: firstly make sure that you know what you're waiting for and that everyone you can contact has done all that they can do to speed that up as best they can. secondly, start looking for an alternative so that if you walk away, you're going somewhere better. And in the meantime, be patient. Its a bit like chinese whispers - by the time your question gets to the person who is holding things up and the answer gets back to you, it won't necessarily make sense as an answer to your question but you gotta just keep asking every few days.

In my experience divorce sales are always like this - doubt its the council, its them delaying/ bickering

Certainly does. We have Relate to thank for messing up an attempted purchase in 2003.
As others have said, consider other options, but firstly, find out exactly what the hold-up is supposed to be about. If you can't tell us, then you don't know enough to make informed decisions yourselves.0 -
The vendors solicitors will not talk to you. Speak to your own solicitor as that is what you are paying them for.
Alternatively get the agent to call them.Estate Agent, Web Designer & All Round Geek!0 -

Dear All,
Thank you very much for all your advice. The day after I posted this message, my solicitor confirmed to me she has received all outstanding document. we are really appreciating all your reply because this is the first time I post on a forum and feel so touching so many people came to help.
Hope the following process will be quicker and once we moved in I will let you guys know.
