Although this is unusual, it does illustrate the dangers of hanging onto a date and then trying to exchange and complete on the same day, especially when you are moving a distance.
It wouldn't have solved the problem but probably would have been less stressful to have had in mind a date a couple of weeks away for moving and then when OP's solicitors tried to exchange they would have discovered the issue and then there would have been possible to walk away from the whole thing or at least the physical move would not have happened.RICHARD WEBSTER

we wanted to exchange weeks before the completion date but due to missing paperwork (that was late coming from their solicitors) we could not do this as by the time said paperwork arrived with our solicitor we could only do exchange and completion on same day- believe me we really wanted exchange before! Hubby spoke to solicitors yesterday and the court date is set for Monday 6th June- the couple are querying the aomunt that they owe- they wont pay up because they believe as they are in dispute over the amount- and the builder (understandably) wants his money. The solicitor has again confirmed that there are sufficient funds after the house sale to pay the builder. On a positive note (i think?!) their solicitor called ours yesterday with the advice that they have told the court and the builders solicitors that this is a matter of urgency that ideally needs sorting out on Monday. I guess wen just wait and see what happens on Monday (fingers crossed!) Thanks for all replies..Now im debt free i want to be fat free too!0

My point is that you had a fixed completion date in mind and were working towards that come what may. Better really to have sorted the date for completion out when you definitely knew that exchange could happen.RICHARD WEBSTER
