    Yes I can see it from both points. The original departure point of the return journey could be intepreted as the US. But I would still argue about why the Insurers did not include an exclusion, if they wanted to exclude connecting flights which were part of the return journey.

    Agree with Dacouch, make the complaint about the wording and how the policy cover relates to people living in the CI. Surely I&G must have some responsibility to explain this gap in cover, if it exisits.

    Have spoken to the FOS and they say they have no official timescales on when the complaint to them could be received.

    However, the Final Response letter I had from I&G states

    "... should you decide to refer the matter to the FOS, you must do so within 6 months of the date of this letter"

    and it's well past 6 months. When speaking to the FOS, they said they would still consider it, but I would have to provide reasons for the delay in contacting them. I don't really have any other than I was so fed up of all the whole issue at the time that I elected to just let it go. It was only recently when cleaning out some paperwork that I was reminded of the issue

    Just go for it and let the FOS decide. I can't see that I&G can put a timescale on it for their convenience.

    Unfortunately, I think they may be able to argue that the time limit should apply. This is not simply one that Insure&Go put on arbitrarily but is written in the FSA rules.

    There would, I think be an argument that "trip" meant from the Channel Islands to the US, not from Great Britain to the US and it was therefore part of your journey but you are going to have to persuade FOS that it was not your fault you did not take it to them sooner.

    My understanding is this. The complaint has to be open as a live file on the Insurers record for 6 months. BUT the Insurers have to maintain details of the complaint for atleast 6 years. If you took the PPI mis-selling as an example issue. Someone could have made a complaint regarding this with the bank, but they still have up to 6 years to continue with the complaints process, which includes review by the FOS. Must be related to the limitations act 1980.

  • Well, claim letter etc. sent to FOS. Wait and see I guess.
