    if i was you i would try getting your ... assets measured properly so you know exact dimensions and only buy from retailers whom you trust to sell bra's that are the sizes advertised.

    learn from this experience and possible stick to the old retailer you use to use. atleast you now have 7 extra pairs of comical ear muffs..

    or atleast keep them incase your lifestyle changes where they may be more comfortable fitting in future if body changes

    if Iam thinking of buying a bra from a high street store and try it on before buying and then don't buy it because it doesn't fit- do the store throw the bra away???? :rotfl:

    of course they don't -and I could have been partaking of any and or all of the activities you mention in your post-they can't FORCE me to buy the item - so they put it back on the shelf for someone else to try and possibly buy later- where is the difference in doing that and taking back a bra which has only been tried on.

    As ANY woman knows, it is VERY easy to tell the difference between a bra that has been tried on for size and one that has been worn for several hours - the straps get creased, the elastic gives - and any retailer worth their salt would be able to tell if the Op had worn the bras for a night out and then returned them and would correctly
    reject their return unless they were faulty.

    having worked in retail ( womens clothing and lingerie) I can spot a bra that has been worn a mile off - I suspect anyone else with a modicum of sense could too.

    the strange thing is that there is no exclusion in the dsr's for 'hygiene' reasons. It just isn't in the regs. The regs do talk about 'goods that cannot be returned' and many folk seem to interpret this as meaning 'can't be resold' and then the hygiene thing comes in as an extension of this. I don't think that this is what 'cannot be returned'. Based on the OFT guidance, it doesn't seem that they think that it does, either.

    The DSR is very vague on this matter and contradict themselves.
    3.38 goods that by reason of their nature cannot be returned. This one is open to interpretation, or abuse by some retailers who will believe it to include underwear. They do mention items that can lose their shape, such as nylon clothing.

    In the OP's case however I think the retailer is right, not the fact that they are excluded due to hygeine, but the fact that I don't think the rules should be open to this kind of abuse. To buy 10 bras in the hope of keeping one or two is just wrong, why should a retailer pay postage costs on 8 items that were always going to be returned. If the op wants to shop this way then that is what the high street is for.

    But the whole purpose of the DSR's is to give the buyer the same rights as if they were shopping in a store. For example, the right to try those items out. Tbf, if the retailer is that worried about postage costs then they shouldnt be trading online. They should be working those figures into their costs - which will still be considerably less than if they were renting a shop in the high street aswell as giving them access to a wider consumer base.

    IMO the only thing the OP isnt entitled to here is refund of the original postage they paid - due to them keeping 2 of the garments. Providing they have taken reasonable care of the items ofc.
