Getting a Divorce Help

Hi,

My wife and I have been seperated for 2 years now, no kids, but a joint mortgage which im living in and paying on my own. I want to file for divorce but it all seems so costly. Does anyone know how this can be done cheaper please? Iv found a website but not sure if this will work or not? Seems a fair bit cheaper than instructing a solicitor etc

    Does she work? If not perhaps if she started the divorce with help of legal aid, the costs will lower.

    My brother was married, split after the first year, but didn't get a divorce till 10 years later (they both had new partners) Because of the cost, she started it all as she was not working. They were not on speaking terms either.

    Might be much different if you were on speaking terms.

    sorry I do not have experience just giving you what happened to my brother.

    Download the court forms yourtself and then go down to the court and pay over the counter. That is the cheapest option.

    If you both agree, it could cost as little as just the court fees.
    £350 petition
    £245 financial order I didn't bother with this part.
    £45 absolute.

    I've been Money Tipped!
    It is important to get a clean break financial order.

    Eg if you inherit your divorced spouse could make a claim, even if you are divorced, if you win the lottery your divorced spouse could claim even if you are divorced, you can sell a house that your ex never lived in and your ex would have a (shaky) claim - unless you have a clean break order.

    Also it might be a good idea to get a new will made.

    As for the divorce - the court staff cannot give you legal advice but they can tell you about procedure and whether forms are filled in correctly etc, so if it is amicable then just go to the court and do it all yourself.

    Obtaining a divorce is cheap, around £350ish if you DIY.
    It's the ancillary relief, (the money side) if one or both argue, that can prove expensive.

    Ideally AR should be sorted before absolute is granted.

    We have no idea whether you must pay her, or vice versa as you haven't stated the length of marriage etc.

    I hope MSE doesn't mind me recommending them, as I direct many from there to here.

    In fact, I wish there was a reciprocal agreement between the two sites. Many over there ask for advice on bankruptcy etc, many here on divorce issues.

  • I got a divorce and did it all by myself. Didn't cost me over £500.

    Having a joint mortgage can complicate matters if you cannot agree on how to split the capital. Matters pertaining to property/capital are dealt with separately from the divorce. See page here:
