Having a few problems with a family member who is administering a deceased estate.
Basically they're saying the estate is under 5K so doesn't need probate or letters of admin, they claim to have collected everything in and distributed it amongst themseleves and siblings but are refusing to allow the siblings to see any of the financial details.
I did some googling the other week and found something about being able to get a court to force them to share the information - trouble is I didn't bookmark it and can't find it now, does anyone have any detail on what it would have been.
Also as it didn't go to probate / letters of admin do they still have to keep records for 12 years ?

was any property involved? if so, then it was bound to be worth more than 5k. otherwise proving that more moneys than that could be tricky unless you have a copy of bank statements etc.0

Theres quite a lot at stake, I know I said it's <£5k but thats what they're telling everyone, it is considerably more as we're slowly finding out.
Just need to know what to ask the court for form wise and section of the law it falls under, can't believe I didn't bookmark the pages.0 -

Their helpline was useless today !Is there anything useful on the Probate Service website? phoning one of their offices could be useful.
After clearly and concisely explaining 3 times over that there was no will, no application for probate, no grant of administration and i'd checked with the local probate registry they said ring your local probate registry as it's nothing to do with them.

Just to add I called up the local county court this afternoon to ask their advice on what form to fill in / letter to bring to the court to get them to issue a notice to the sibling. What a waste of 10 minutes.
They didn't know anything about the Administration of estates act, didn't know what form i'd need to fill in - i told them i thought i knew which form it is and if I was to fill it in, bring it to the courthouse, pay my fee would the desk check it before taking my fee to make sure it was right, they said no it'd get to the judge and they'd just throw it out :wall:0
