I take it the tree was on the road, and also that you took pictures of the tree, and its braches.

i took pictures, but the tree didn't land on the road because my car was in the way, hit the roof, then slide down the door and rear quarter

Just a few suggestions. I won a case last year against TFL for a pothole. I was put in touch with there insurance company, zurich. They request details, and made me wait three months without a reply. After several pesting calls, the coughed up the replaement of a new tyre.

I know you have contacted the council, but also bare in mind, all local authoroities including your council have a complaints procedure in place - just a thought!!

In regards to the damage, sounds like the tree really came down on the car. Not sure on the law, but the council are responsible for maintaining and pruning trees on the highway. I think you have a good case, and hope you win, you deserve it, good luck
