How to word a Credit File Fix letters after DRO

I've seen the credit file fix for post bankruptcy but how do I word/ re-jig it for post DRO.

If it wasn't for the mistakes I made in the past (and learned from), I wouldn't be who and where I am today. It doesn't matter if you've cocked up, what matters is that you put it right and apologise. x

    After consultation with both the Information Commissioner and the Credit Reference Agencies, I am writing directly to you to request that you formally update my credit files in accordance with the Data Protection Act.

    I was subject to a Debt Relief Order which commenced on <Date of your DRO> and subsequently discharged on <Date of Discharge>, and <name of creditor> was included within the DRO.

    For your convenience I have attached <whatever evidence you have of the DRO and it's completion>.

    Currently the information that you have recorded against my name with the Credit Reference Agencies is factually incorrect, and despite several written requests to your customer services , as yet your company has failed to correct the entries as required.

    • It is required that you record a default on the account, and that the default entry must be no later than <Date of your DRO>, in accordance with the Data Protection Act.

    • It is required that you mark the account in some way as to indicate that it is settled or satisfied, in accordance with the Data Protection Act.

    The Information Commissioner has indicated that I should allow you 28 calendar days from the date you receive this letter to comply, during this time you are requested either to update the Credit Reference Files correctly (of all three Credit Reference Agencies) or notify me in writing the reasons that you refuse to.

    After the 28 days have elapsed the Information Commissioner has requested that I inform them if your company fails to update the records so that they may take any necessary enforcement action against your company.

  • This is really useful Femi, many thanks. My DRO is coming to an end & I was wondering what I had to do next.
    2009- 5 debts
    2010- 3 debts- 2 gone :j should be only 2 by years end.

    2012- DRO ended! :beer: Just student loan to pay off.

    Can i just add....don't hand sign the letters! Please type your name, saves any hassle of companies using your signature for other letters etc

    Just what I was looking for! My DRO ended in March and I now have companies chasing me for debt that's in the DRO! Although they wont say what debt it is for I know the only debt I have is in the DRO.
    Thanks for this I will have to send it out to everyone this weekend and hopefully get it cleared up :o)
  • Hi there, this has been a great help, thank you so much!!

    My DRO has just ended this month and I have my discharge notice and letters in hand however my question is;

    I will be sending a copy of the discharge notice to each creditor and I was going to send a copy of the DRO also but I do not want every other creditor to see my other debts. How do you suggest I get around this? Or shall I stop being so paranoid?

    any help would be great

  • You dont need to send your DRO approval paperwork!

    Your creditors already know you were subject to a DRO and would have been informed by the Insolvency Service when your DRO was approved!

    The above template and copy of the Insolvency Register report about your discharged DRO will be enough!

    I had cleaned up by credit file and all creditors had marked as settled, until I decided to do a statutory report on 3rd of January and found Orange had updated in December and put that particular file back to red :mad: I emailed the CEO the letter again, but have not received a reply yet!

    How annoying!!

    Hi,

    I am now in the process of getting my credit file cleaned up after my DRO finished in november, the above letter template looks great BUT I never received any confirmation my DRO has finished? I have no evidence so to speak that it has finished so what should i do?

    As your insert on the insolvency register will now not exist, the only thing I can suggest is a phone call to the insolvency service Dro unit! I did this when I was having trouble with orange who wouldn't accept a copy of the insolvency register as proof, they instantly emailed me a headed letter stating the date my Dro started and the date it ended! That soon shut orange up and had the file on my credit report corrected :)
