Could we get housing benefit?

Hi all I was looking for some advice if possible.
I've got 6 a month old son and I still live at home with my parents. At the moment i get income support, child tax credits child benefit and CSA started in may.
Now me and my sons father have decided to get back together and move in with eachother for our sons sake now this is where I get confused.
I know my income support would stop child benefit id still get and id get child tax credits and working tax credits as he works.
Hes contracted to 32 hours a week but he does do 40+ for overtime now obviously if we move intogether he wouldnt be able work overtime as that would be fraud.
Now I was wondering I have gone on a few benefit calculator websites and it asks for council tax etc and i dont know about that as ive never had my own place.
My sons dad earns 200 a week before tax etc. Would we be able claim housing benefit?
I've seen a 2 bedroomed house 400 per a month which is private renting. And my LHA is 90 per a week for 2 bedroomed house but he works.

Why would your partner working 40+ hours be fraud?
The amount of LHA you might be awarded depends very much on how much your partner earns. You will be able to claim child benefit, possibly working tax credits and maybe some council tax and LHA. If your LHA allowance at the moment is only £90 per week and you want to rent a house for £400 then it is reasonably likely you'll need to meet the majority of the costs of that yourself.0 -

I think the OP means that if they used the figures that her OH earns for his contracted hours then they may be entitled to some benefits, but if they used his 'overtime' figures their entitlement would be less or no entitlement at all. OP thinks it would be 'fraud' if they claimed on his contractual salary and not include overtime.
Does that make sense? OP - is that what you meant?
From memory, figures used to assess benefits (not tax credits which are based on last year's figures) are from the average of the last 3 months payslips (happy to be corrected). Also, I believe there is a way to have benefits assessed when the applicant's earnings are erratic. (Not sure if this is true of all benefits - pehaps someone 'in the know' could clarify for each benefit?)0 -
You will very probably get tax credits still on your partners income, although this is based on what he paid in tax last year (in part) so don't worry about whether he does over time or not. If he works more hours it doesn't matter as it is his income which is counted and any benefit entitlement will require proof of income, old payslips.
Housing and council tax benefit will also be based on that income along with your tax credits. You may well get some help and the only way of finding out is to apply. Then sort out your budget for living.
