To be fair, even if he bought it as a gift, he probably expected to have use of it, which he won't now you're splitting up. How much is the car worth? I think selling it and getting two cheaper ones sounds like a good compromise. It'll be better to keep things as amicable as possible, for the children's sake.0

What car is it?!
If it's quite an expensive new car, then could you not let him have it back on the basis that he buys you another cheaper one so that you can get to work?
Or just sell it, buy a cheaper one, and use the leftover money for a house bond!
Actually, did he buy it with cash, or did he buy it on car finance? If the latter, and the loan hasn't been paid for, then it will belong to the loan company, so you might actually need to give it back if he didn't pay for it outright. (otherwise the car loan people could seize it if he didn't continue paying the loan, and I don't think you'd have any right to keep it, as he shouldn've given it to you...)Should've = Should HAVE (not 'of')

If it was cash and there's no receipt to link it to his name like card payment for example, then he could take you to court and still have no hope in hell of getting it back.

Things were okay berfore we lived together but now all those differance which before we could just ignore cant be ignored I am no longer the person he really wants me to be and vise virsa. Its very sad i am already on anti depressants because of the situation and it is badly effecting my mental health.
For example- I work full time and do all the cooking and cleaning etc whilst he sits and says he has been to work all day so why should be help with anything even though i work full time too, We have rowed constantly about this and many other issues but he states he is a man and should not do house work ! There are many more issues we disagree on also i think it is beyond saving to be honest

You can't live with someone with such silly ideas, it's teamwork, not point-scoring that matters.
Imagine if you had to have a major operation, who would do the housework then?

So everything you bought him is yours in his eyes then if he is saying the car is his as he bought it.
IMO the car is yours. When my ex left me 3 months pregnant and went back to the mother of his first child (who left him 8 weeks later!!) he asked for the engagement ring back!!! We had only been engaged just over a week, so I took it back and got my money back - he wasn't happy lol.
Hope you manage to sort a property out for you and the children.
