HELP NEEDED PLEASE....Barclays bank charges claim

Hi all I originally started my claim for bank charges back in 2006/07 I got as far as court before my claim was put on hold due to the waiting of the test case outcome.
Anyway test case outcome was announced and I heard nothing else from Barclays or court.
I then noticed on here if you were or still are in financial hardship you could try again to reclaim as it counts as financial hardship and you can go through the Financial Ombudsmen route.
I wrote to Barclays last week stating I was going to go that route and they sent me two replies dated within a day of each other.
The first said sorry to hear of financial difficulty we will provide assistance and pass on your details to a specialist dept who will consider your financial circumstances and determine if there is anypractical advice or support we can offer they will contact you within the next 10 days and we have included various leaflets etc to help you get your money back on track. It then goes on to say we are not upholding your complaint about bank charges and we will not be refunding any charges. This complaint has been dealt with independently from the view of your financial difficulties to be undertaken by our specialist team and has now been closed it then gives a phone number for me to contact them on if I wanted to discuss it further.
The next letter dated the following day started the same saying sorry regarding financial difficulties etc and that they would look into the concerns and let me have a response no later than 29th June 2011. It then gives me a budget planner to complete and return.
I am totally lost on were to go next as it sounds by the first letter that they will not reopen the charges claim I had originally issued them with could someone please advise me were to go next I have looked on the site and cannot find any onformation to help me Many Thanks Kelly:)

Fill out the income and expenditure for and send it back to the bank. This will alow them to assess your financial position. Refusal to do this means they are unlikely to help you. They will decide whether they feel you are in financial hardship or not.
If they do deem you are in financial hardship, they must be sympathetic to your circumstances, which could include setting up payment plans, refunding charges (typically the last 6 months) etc. If you are unhappy with wat they have offered you can then refer to FOS.
If they don't deem that you are in financial hardsip, find out their reasoning and if you remain unhappy again, you can go to FOS.Best Regards

Have you received any response since sending in thatplanner. I ask as I received a letter including tat form and havebeen asked to complete it as well. Will be grateful to hear from you.0

Hi is there any response to this? I also ask as I've received a phone call today from them saying they won't be paying out as the charges were legal and they've refered to to their specialist finance team but he said it will affect my credit rating.
