Overhead phone line

Need advice please...

The new build house next door are getting a BT phone line. Openreach have been out today and erected a tall telephone pole between our properties at the gable end. It is about 2m from their wall, 5m from mine, but the overhead cables will run through my garden - possibly through 45ft trees that we're thinking of taking down this year.

Do they need permission for this? We live in a conservation area.

    generally no, they dont need permission. utility companies have certain wayleave rights.

    They need permission to run cables across your garden. They do not have an automatic wayleave.

    no they have certain rights of way. if the pole was in your garden ect then they would need permission to do any work but if you were planning an extension ect it wouldnt hurt giving them a phone and state at some time in the near furture you would be having work done at the location that they have installed the pole and line to my neighbours property and suggest to them they would have to pay for the lines removal and possible reinstament and they may just move the line for you free of charge :D good luck

    If the pole is on your neighbours land then then Openreach only need permission from the landowner to place the pole there.
    They won't need a wayleave for it unless it ends up feeding more than the landowners own property.

    As far as the overhead cables go, no permission is required to fly them over a separate property from where the pole is installed.
    If the cables are underground and actually in or on your land then they need a wayleave from you for the cable to be there.

    If you are not happy then check the pole, there should be a white A4 page fixed to it. There will be contact details on it should you wish to object to the pole being where it is although if its on someone elses land you'll likely not have any joy in getting it moved.

    I wouldn't hold any hopes that telling Openreach now that you may be making alterations in the future will either result in getting the wires moved now or in the future.
