Agency Refusing to pay

Hi I started a temp contactract about a month ago I worked a day and didn't like it or the people there so I rang and told the agency and did not return.

Anyway they are now refusing to pay me for the day that I worked there I did about 8 hours in total.

Are they allowed to refuse to pay me? What is the best course of action to follow this up and make sre I get paid what I am owed?

    Tell them politely to pay up or you shall take legal action against them they have a duty to pay you for hours worked and cannot withold it !

    What is their reason for refusing payment? Did you get your timesheet signed before you left?

    As said above Did you get your time sheet signed before you left?

    A few agencies I've worked for made it MY responsibility that they received the time sheet appropriately signed. If I didn't get it signed they would not pay me. It was part of their standard T&C's that I had to sign before they would allow me to work for them.

    (I don't know what the technical legal position would be though?)

    Would have been interesting to find out if the agency billed their client when not paying you .I wouldn't put it past them to have done this.

    No timesheet, no wages is the general rule. They have no proof you worked so also cannot bill the client.

    If you worked at a company with a clocking in machine and you didn't clock in for a week, you'd not get paid without one hell of a battle.

    Employment legislation clearly states the absence of a time sheet is not sufficient grounds for withholding pay .
    The Telephoning stage is over
    Write a recorded delivery Letter stating "notice before action" stipulating that if they do not pay within 14 days you will refer the matter to your local county court for a judgement to be made.

    THanks for all the replies - I did not get a signed timesheet. I have given up phoning /emailing them now. I am sending a letter recorded delivery threatening legal action. It was only one days work but it is stil money owed - I'm not letting them get away with this.

    Don't you think that's abit strong considering that you haven't upheld you part of the bargain?

    It is correct that handing in a timesheet is no longer deemed enforcable, however it is expected that the agency are able to confirm your attendance for the hours you claim to have worked, not just pay you upon your word. Did you sign in/clock in at the client company?

    you worked the hours you are due the pay make sure you let them know that you will persue a legal action against them it will cost you £30.00 plus you can charge interest at 8% approx per anum so if they owe you £50.00 x by 8% divide it by 352 and stick on the claim, once they either get your letter or the court documents I would imagine they may soon change there tune but if it were me I would say that any amount that they offered me was to include court costs regardless wether you have started it or not.

    Most of these agencies are shysters anyway !

    You should seek advice from your local inspector of the Dept of Business, Innovation and Skills. You are entitled to payment for the work you have done and the agency could be guilty of a criminal offence by witholding your pay. The correct website is here http://www.bis.gov.uk/
