hi all im new , last year i was stopped being given dla and i have just had my tribunal after a long fight and i had a d.l.a tribunal appeal and i won it last week and it is to be back dated too . I spoke to someone at the call centre at the dla and i asked them if anything has been updated on the computer regarding the tribunal , she then asked me if i could answer some questions over the phone saying that the information needs up dating from last year as it has been a year since i had filled in my dla form she wanted to see if my condition had changed etc etc . Now i thought this was a little weird and i told her the reason why i went to the tribunal and this was to be asked all the questions that needed to be answered and i declined and said i will not be answering her questions and she was rather rude and said " well we will leave it there then and this will only cause a delay in things ". I then spoke to someone in the department who was dealing with my claim and i told her that someone told me that i needed to give them more information and she said " who told you that " and i stated that someone from the call centre asked me to answer her questions on the phone and i asked the office why was this and she told me that they might ask me if i have spent any time in hospital in the past month etc but it sounded like the lady in the office knew nothing about the call centres asking questions over the phone . Anyone had the same experiences or is this a trick and a trap on the dwp part even though i have won the tribunal i thought once you had won the tribunal that was that with the questions and that the paper that i got at the end stating that i am entitled to d.l.a and it will be back dated until the date of expiry, and the document was a legal document .

  • After a DLA tribunal, the decision will be sent from the tribunal to the DWP.
The decision maker will then check that the tribunal is correct in law, and no errors have been made.
It is then practice for them to send a letter out to you, checking if there have been any changes to your condition, or if you have had any stays in hospital. This is because these things could affect the amount of back pay received.

Once this information is received, then the DWP will finish processing the award.

thanks munchings and crunchings , i thought that the problem was the fact the d.w.p did not accept what i sent in on the application or the evidence in the first place but want to ask more questions after the tribunal has been won
  • i have read some posts similiar so i guess i will have to wait :)
