Settled Default Removal

I recently got a copy of my equifax report and found Capital One had placed a Settled Default on my file! I was totally unaware that i had even been issued with a Default notice. When i wrote to Capital One to ask them about this they said they had issued me with the default notice by post in 2008. I advised them that i had never received this and requested they supply me with a copy or remove the notice from my credit file. Then today i received a letter from them with a copy of the default notice they supposedly sent, advising that they do not now need to reply to any further letters i write to them and that if i disagreed with this i could write to the Financial Ombudsman. Is there anything i can do to get this removed or any template letters i can use to send to the Financial Ombudsman? Thanks

    If the default is showing as settled what is the problem here?
    Me thinks we have not had the whole story.

    Because a settled default is not better than a default.

    ah but did you know you owed the money and thought you had got away with it.

    A default will stay on your record for 6 years, whether it is settled or not.

    It's very rare that one is removed.

    It's too easy to say you never received anything and it isn't a reason for removal I'm afraid.

    How long were you in arrears?
    When did you pay the account off?

    Hi! I was actually made redundant so i called them to advise that my financial situation had changed and they said i could make payments of £25 a month and then could review the amount every 6 months. I made three monthly payments of £25 and then started to pay £100 a month for just over a year, i then transferred the remaining balance to another credit card and then closed the account. I think i missed maybe one payment in that time.

    What do you mean, 'get away with what' you know exactly what i mean.

    The rest of my post was helpful in that it gave you information that is fact.
    As a newie, you have to leanr on this forum that a chip on the old shoulder will get you nowhere fast matey.
    No one will want to help you if they expect to be virtually spat at.

    So you did default form the original agreement.
    It's extremely unlikely you will get the default removed IMO.
