I need some advise and wondering if anyone can help?
I recently brought a car from a trader and the day after it over heated, upon further inspection i found that the fan is not working, the aircon is not working, the radiator is not working and possible head gasket.....i also found out the car has been in a cat d and my insurance company will not insure it. I have asked for my money back but they have said no they want to fix it but i do not trust them to do a good job or even to return the car back. I also paid full price for the car not knowing it was a cat d and now its probably worth 50% less than what i paid!!!!! I do not want that car under any circumstances and i just need to know what would my chances be in court??? thanks

The trader was obliged to tell you and if he didn't you should reject. This may help you in deciding how to proceed;

Write a formal letter to the trader and say that you are rejecting the car under the SOGA as you have become aware that it was a cat D write off. Indicate that you want a full refund within 7 days and suggest that they arrange to collect the car from you. Also indicate that all correspondence is to be done in writing only. Send by recorded delivery but once sent, do not use the car again. If after 7 days have passed and you have not had a response contact your local trading standards office and ask them to look into as they may take the case on for you (as the case in the link) which will save you the hassle of going through court yourself. However, should you need to, come back for further assistance.PLEASE NOTEMy advice should be used as guidance only. Are you sure you did it in that order?
Did you look at the car at all or get it running? This all looks like really easy to spot stuff, no offence meant but they have had your trousers down here.

Get all of your money back, the guy is a chancer and remind him that the 2008 law means that his misleading by omission leaves him wide open to prosecution.0

The Garage may have provided the OP with 7 - 21 days free Third Party insurance which the garage buy in order to to tax the cars. It saves the trouble of waiting for a new insurance certificate for the new car from the buyer before it can be taxed. This has happened a couple of times with me.We need the earth for food, water, and shelter.

Cat D is the lowest form of damaged classed by Insurers, a friend of mine bought a Cat C a number of years ago, hes still got it now, passes every MOT etc, only down side it will reflect the resale value when you decide to sell.
Some extra info for you:
Category C or D write-off is one that insurers consider unecomonical to repair but one that could, given enough time in the workshop, be repaired and returned to the road.
Category A and B should never be returned to the road. A Category B write off is one that is so badly damaged it can only be used for the salvaging of spare parts, while a Category A is one that is sent to the crusher.
Ultimately, Cat C/D just means that the Car has been declared Repairable by an Insurance Engineer, and the Insurance Company concerned did not want to pay for Repairs. Why they did not usually has more to do with their own internal policies, than with the Car itself. Always remember that Insurance Companies are not in business to Repair Cars. They are in business to charge Insurance Premiums. unfortunately a cat a or b car can be returned to the road if its satisfies a vic check,the abi dont like this but unfortunately not all insurers are based in the uk so dont have to abide by abi guidlines also many smashed up cars never get categorised as they were self insured by very large companies like driving schools ,best advice really is do your own checks if you dont want a cat c or d because some of these cars are better than straight ones if they come from responsible repairers
