HI ACAS have a dedicated section on their website for mat leave queries @ https://www.acas.gov.uk. They are independent, FREE & confidential, also have a helpline. The government have TIGER website (Tailored Interactive Guidance on Employment Rights) web site where you can work out your entitlement https://www.tiger.gov.uk.
If you get company mat leave in addition to statutory/government pay, & don't return to work, you're likely to be technically liable to repay.
However, if say it happened that you went off sick when you're due to return & stayed off for a couple of months, it's pretty likely that the sick leave would supercede any requirement to repay mat leave back. Alternatively, apply 4 a career break if these are offered but the same conditions are likely to apply atr the end of the break, i.e. return to work ALTHOUGH normally only for about 1 month (check your contract) or repay original company mat leave. Thanks to all for some great help and advice.
If I could stay where I was I guess there wouldn't be such an issue but my OH and I have lived apart now (because of the new job) for 4 months and I've hated every minute of it.
I really don't like the idea donna-j of just getting to grips with a new job and then leaving for a while either - but I'm afraid time's running out
It took me a while to find my Mr Right so everything's happened a little later.
I'm so glad I asked the question too do it today! I was really worried and now I don't feel quite so scared.
