Would I be entitled to anything?

Hi

Other half and I run a business, well, it's his business really. I'm a 'partner' but only in name - there's nothing in writing.

I've been here a few years and it's not really what I want to do with the rest of my life, and I'm a bit fed up about a few things, working and living together isn't always easy! I'm strongly considering going back to my old career and have started applying for some jobs. I have warned OH about this.

But now I'm thinking I just want to go fairly soon and concentrate on job-hunting. What would my situation be for any Jobseekers etc in the meantime?

I am on a small amount of PAYE but most of the money is being ploughed back into the business. Am I entitled to jobseekers? would it better to say I was selfemployed but have had to leave the business? Or that I was an employee and made redundant or something?

I'm not out to be greedy, I've worked and paid tax all my life and only claimed for about 3 months donkey's years ago,

but I want to know what would happen if I just said, right, I'm going, one months notice, is there any way of getting jobseekers/any other benefits?
Cash not ash from January 2nd 2011: £2565.:j

OU student: A103 , A215 , A316 all done. Currently A230 all leading to an English Literature degree.

Any advice given is as an individual, not as a representative of my firm.

You would be making yourself unemployed. Therefore any claim would be sanctioned.

Have you been making Class 1 NI Conts over the past few years? Could you not just jobseek whilst still drawing a wage from the business?

If you're an employee (which you are if you are paying class 1 NI contributions) then you're not a partner and you're not self employed. And if you're an employee any contribution based JSA you would have been entitled to could be stopped for up to 6 months if you just left.

If you are a partner and self employed then you wouldn't be entitled to contribution based JSA.

Can't think of anything else you would get, assuming that you are living with your partner and that he or she has an income from the business.
