It goes back to when you bought the property. Did you think you were buying this piece of land? What documentation did you receive to suggest that?Ok, our garden is on our deeds, the land they have put the other garden on isnt on our deeds but it might as well be in our sitting room! As it affects our privacy, value and selling oppotunity I just need advice on whether the council can do this?!
From what you're saying, you want someone to tell you the council has done something wrong in placing fencing on land it owns. That's clearly not the case, so we need to look back at the time the property was transferred to you.I am a mortgage broker. Not sure why everyone is finding this so hard, I read this as the council sold too much land on one side of the property, meaning there was no room for another garden for another flat.
Poster happy with this mistake until the council rectified it by placing a garden (fence) around land that was probably just unfenced off greenery on another side of the building.
So happens that it now means OP living room window is looking directly into the new garden. Does seem slightly inconvenient, but the OP wasn't complaining when they got too much garden:cool:Mortgage Balance £182,789.00 of £259,250.00 Overpayment Total £48,847.13
