Bank Holiday Pay

Hello,

I'd appreciate some advice on Bank Holiday pay rates. Hopefully I have given all the info you need, but let me know if you need more....

I work for a large public organisation. My working hours are Mon - Fri, 37.5 hours per week. I get 28 days holiday not including the 8 bank holidays. Officially I do not have to work the bank holidays, but instead, one person per team is asked to "volunteer".
We do have colleagues who work shifts, who's bank holidays are worked into their hours and their pay, but mine is not.

I "volunteered" to work Good Friday and Easter Monday, expecting to get double pay (£13 x 15 x 2 = £390).

I have just been paid, and have been paid £115 for the 2 bank holidays.

A telephone call to payroll (done by a colleague in the same boat, not myself - they couldn't be bothered to call me back) and we learnt that for bank holidays we get "enhancements" and should get 60% of a normal day for a bank holiday, thats it, NOT double pay.

I don't understand how this is right, as if I chose not to work bank holiday, then I would in effect get my salary, plus 28 days holiday, plus 8 days off as bank holidays. Say I chose to work all bank holidays, I would get my salary, plus 28 days holiday, and paid 60% of 8 days - thus for those 8 bank holidays, I would only be getting paid approx £7 per hour.

I find this really confusing, and I might have jumped to totally the wrong conclusion. If anyone could offer any advice it would be much appreciate..... I feel like going on the war path when I turn up at work tomorrow!

Thanks.

won't you get your holiday pay plus the 60%?

    Hi Googlewhacker,

Payroll say that the pay for working the bank holiday is already included in our salary, so with the extra 60%, I guess they are saying we would get paid a normal days pay plus 60%.

However, as I see it, if bank holidays are not compulsory, the pay can not already be included in the salary, therefore what they have paid is only 60% of what I get paid on a normal day.

If it helps, it was broken down on my payslip as:

    Description: bank holiday
    worked / earned: 15
    paid/ due: 9
    rate: 13
    Thanks

Bank holidays do not exist. They are a fiction. So because you work a bank holiday, that does not entitle you to anything but normal pay. Your contract may entitlle you to more. But there is no automaice right to double pay - or anything more than single pay

Well, seeing as my contract says I am entitled to bank holiday off, and when asked to work the bank holiday, my manager said (in an email) that we would all get double pay, this DOES entitle me to double pay surely?

I doubt just because your manager may have incorrectly said it that it would count, HR will be the ones that contol this and yes your salary will include your holiday pay so if you are getting 60% on top then effectively you are getting 1.6 X your normal days pay.

Shame you didn't include this in your first post in this thread rather than the third one.

Googlewhacker thanks for your reply, but it still makes no sense why, if i don't work a bank holiday then i get paid for a day to sit at home, whereas if I do turn up and work, I get 0.6 what the people who dont work get paid. It doesn't make sense, but maybe I'm just too stupid to understand it.

No your not being stupid, you are gettig paid 1.6 to work or 1.0 to stay at home so you are earning extra compared to normal.

I see two choices, you either drop your manager in it by forwarding the email onto the HR department or you goto the manager and ask them about it and if it is a genuine mistake then personally I would leave it because your perks are good anyway considering the stat minimum holiday is 28 days total including bank holidays so you are getting a full 8 days extra less any you work.
