failed ATOS medical, please help, next steps..

Ive just found out ive failed the atos medical (UK) for ESA.
Ive called up my job centre to ask for the medical report.
I cant believe i scored 0 points on both questionnaire and medical. This is not right, i filled in the questionnaire very thouroughly referencing the descriptors and i was confidant i would score over 10 points at least if not well over 15.
The medical interviewer told me he didnt even read the questionnaire i had filled in, saying i wrote too much and basically he couldnt be bothered.
just wondered my next steps.
the letter says 'you will get a further letter explaining how they made decision'. So i should wait until i receive this?
So i presume my ESA has stopped now.
when will it be re-instated? when i make an appeal?
the letter says i can ask for explanation, reasons, ask them
to look at it again, and finally appeal. Shall i do all of these in order, one at a time, or all together immediately?

yes, two times if not 3.
said it was too lengthy, and that he would be there for a week reading my answers. the time in spent on that form, and they couldnt even read it. just said he skimmed through it quickly.0 -
That's so awful, I'm sorry.
I think your best bet would be to go and see the CAB for advice on how to go forward with an appeal, and also an official complaint regarding the examiner if I were you.0 -

At least they were honest enough to admit they acted unethically....[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.

The last medical I was at for IB I was also told by the doctor that it doesn't really matter what was on the IB50 form that I filled in, that at the end of the day it was what he stated on his report at my medical that counted towards the decision.
He give me a really hard time at the medical I felt, and I was sure that I had failed it, but was passed for continiong IB nevertheless.

What the heck is the point of sending out these questionairres if they are not going to bother reading them? Geesh...beggas belief. Definitely raise a complaint so it can be looked into. Maybe it will help your claim and maybe it wont, but pure logic says that that your answers should have at least been read properly, not just skimmed over. Good luck:EasterBun

Hi, my husband also failed the medical for ESA. I got the letter saying so the day after visiting his doctor and being told that he would be needing an operation! I phoned the job centre helpline and was told that I would need to make an appeal about the medical, but our claim would be stopped until a decision was made. Our claim was, infect, reinstated once they got our appeal letter and a few months later we got the letter saying that our appeal was upheld. I hope this helps, it apparently happens quite alot. Also if you are getting housing benefit, I would suggest you also ket your landlord know as our rent was also stopped without warning. Becky

Also I would give the job centre a ring as we had the start the letter a specific way or they wouldn't even bother to read it!!! Becky x0
