DRO Help

I have done a DRO and a major debt was left off the agreement, is it possible to do another DRO for this debt?

    You can't apply for another DRO if you've previously had one within the last 6 years.

    How much is this debt and what was it for? Is it being chased?

    The debt is for an overpayment of housing nd council tax it amounts to around £1000 I think. It is now causing rent arrears because they are recovering it at £13 a week which is wat they r expecting me to pay, but that is a lot of money per week for me to pay out as I'm on benefit.

    Hi,

    As Fermi says the debt can't be added and you can't have another DRO for 6 years. You should contact the council and ask them to recover at a lower rate. If you are on income support or income based JSA /ESA then £3.30 - £5.00 per week would be more appropriate.

    Thanx for replies, I have asked council abt a reduced payment nd they said cos it is connected to a fraud overpayment that's the minimum I can psy £13. the fraud is because I had more ctc which I didn't know abt so I didn't inform council.

    sarah did you forget to tell your ai about this debt or did they forget to include it....the reason i ask is because my dro was approved over 6 wks ago and my ai accidently put the wrong figure down on the form for one of my debts wen it was submitted....i didnt realize till i got home and i contacted her straight away.....she sent a letter to the OR explaining her mistake and my dro was ammended with the correct amount on it..

    I didn't realise he didn't know about it, I told him at the 1st meeting I had with him. I only realised it wasnt on there when I got the copy of the dro nd I contacted him immediately but it was too late to add.

    iff u definately told him, just ask him iff he will get in touch with the or and ask for an amendment...iff he wont then you could always write or email the or yourself and explain everything.....it might not do any good but its worth a try....good luck sarah..x

    Hi,
    An intermediary has to be very quick to notify the DRO unit if they want to amend it, definately within 24 hours with the case of a 'missed debt'. To have your debt being classed as fraudulent one of three things MUST have happened;

    You must have admitted fraud under a formal caution interview.
    or
    You agreed to pay an administrative penalty under the 1992 Social Security Administration Act
    or
    You were successfully prosecuted in court.

    Otherwise, the o/p is not fraudulent.

    Same here, cept my overpayment amounts to nearly £3000.
    Mine was due to tax credits going up £1 one week, £5 the next week then down again then up again. I didnt know the tax credits tell the council and the council wait till the end of year review to tell you....'hang on you never told us about 9 changes of income this past year'
    I was soooo looking forward to a DRO but thanks to this £3000 it put me over the DRO limit.

    Regards the original post you can not another DRO. Also i thought you could get into trouble for leaving a debt out? But if its your AIs fault then im not sure.

    you would only get "into trouble" iff you deliberately leave a debt out in order for you to be below the £15000......iff its an oversight and you genuinely forgot to include it or if your AI forgot then im afraid you are stuck with this debt...
