Thanks, so you would argue that the term"default" refers to a payment default not the default of the DD per se?
I would, yes. Others have been in your situation and reported on here that they've successfully got both the fee and 0% back.
    Are those the MBNA t&c's?
    They're your Virgin T&Cs.

Thanks, I have made a Word doc of all the info here (inc that contained in your link above) and I will use it during my callback. Hopefully, common sense will prevail and the manager (unlike the original CS agent) will have the discretion to remove the charges and reinstate the offer.

ETA is it worth asking my bank when they notified MBNA of the dormancy of the DD?

Most people on the "floor" (I am assuming this was a phone call) are unaware of AUDDIS rules/regulations.

when I initially asked the CS agent there she said DD never expire! it was only when she checked with her manager that she discovered there was a dormancy period.

Is about time people there got full training and education.
No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

Always worth asking when you take advantage of a repeat deal with any card if there is a valid direct debit set up on the account.

    Update:-

I got the callback, and before I launched into the info given above the manager said he had reviewed the account and it was clear this had been an error on their part and that he would refund the £12 and ensure the promotional offer was maintained. He said it should have been obvious to the CS agent who originally dealt with my call, and that he would be speaking to him regarding the matter.

So, a good result. Thanks to all who helped with such useful info though, it is always better to be well armed and had I needed to I could have argued my corner from a position of strength.

    Thanks again.

Nice outcome, it did seem odd!
