Is this right?

Hello Everyone

My FIL has currently gone into a private rented property, he is on IB JSA and my MIL is in IB.

They currently have around £20,000 in savings and been told he will not get anymore payments from JSA because of his savings, but signs on for his stamp, he has notified them of how much he has in his savings account and gave copy of his bank statements....

But they are still paying him is IB JSA and He is still receiving full LHA Benefit and full council tax benefit, he had a letter from the housing benefit stating he can still get full LHA Benefit, because he is still claiming IB JSA

Is this right? It don't sound right to me and I have told him to leave the payments that are going into is bank account, as they may request for them to pay it all back.....

Thanks In advance

If he is receiving JSA IB then yes he will still be entitled to full LHA and CTB, has he checked with DWP that they are using the correct figures for their assessment.

Do you know which rate of IB you MIL is on? I'm assuming they will have a disability premium which increases their applicable amount

If they are not entitled to income based JSA they will not be entitled to LHA or CTB as they have over £16k in savings

They currently have around £20,000 in savings

There are some few types of awards and compensations that can lead to savings which are disregarded for benefits purposes.

If it's 'ordinary' savings, then they are not entitled to income-based benefits at all, as they are over the threshold of 16000.
  • He has checked with DWP that they are using the correct figures, they have him down with that cmount of savings...

His savings are not ordinary they were from a endowment policy he cashed in on to keep them going through their rough patch...

She is on Long term rate for IB, she has been on it for the last 9 years at least.
