it'll take months to go through court, unfortunately. It's a slow process. I would shelve any thoughts of getting your costs back - it's very rare in these cases and the person awarded costs has to have behaved very badly, not filing the right documents, failing to turn up in court multiple times etc. etc. I think that the fact she's messed around for the last couple of years won't mean much at all. If you think about it logically, how is a judge supposed to know which half of a separated couple is the one who's messed about?! There can be a vested interest on both sides to refuse to come to an agreement, even if it's not logical to do so. People behave very strangely in separation and divorce and the courts know this! He can represent himself to keep the costs down - it doesn't sound like there's anything to be fighting over, no large pensions or massive loans that need dealing with? Have a look on https://www.wikivorce.com as there are people there who self-rep and are happy to give advice.

Hi Clearing Out....it has all been documented by his solicitor how long it has taken for her to respond to solicitors letters etc....months at a time just to respond to correspondence. There is nothing to fight over...she is being spiteful now as there is no equity in the house...he wants to take over her part in the 10k debt...and hes been paying it the last 2 years and shes not given a hoot about that...but says she wants rid of debts...funny way of showing it I think

Thanks for all advice keep it coming x

    Hi Shortbread,
Sorry to hear of the troubles you are having. I'm going through a roughly simular situation where I am taking an ex partner to court to get him off the mortgage. I cant post links yet but I've posted my story and its my only thread :-)
My case was made more difficult by the fact that ex has not responded at all or shown upto court, he has therefore been awareded costs currently amounting to £3200!!!
Mediation wasnt really an option due to extreme lack of comunication from ex
I'm not an expert by any means but feel free to ask me any more
