Rent liable when business closed?

My flat mate is a self employed barber and has to pay rent every week. His contract says that the salon must be open no less than 250 days per year for him to operate. There is however nothing to say whether rent is payable during salon closures i.e. if the owner goes on holiday for 2 weeks. Is rent still payable for those 2 weeks?

    That is a rather bizarre contract. Although when you say contract, do you actually mean lease?

    Does your friend have a franchise or is it his own business? Who actually has the lease of the shop? Your friend or another business?

    I'm no expert but I would have thought rent should still be paid in those two weeks. You need legal advice in this instance probably. It also sounds as though legal advice should have been sought before signing any agreement too.

    I would imagine that the 250 days are simply a minimum term of a contract, not that it will ONLY be open 250 days and would have thought the salon would remain open even if the owner went on holiday or whatever, particularly if the salon is run on a rent a chair basis, there are likely to be others that rent. It would seem somewhat silly to rent a chair in a place that could potentially close for almost 4 months a year.

    I would talk to the owner, and also other "renters" but I think its likely he would pay rent year round and choose his own holidays, for which he would still, I assume need to pay rent to keep his chair. If I owned a salon where chairs were rented, I would gladly be open whilst on holiday! Rent coming in, and me lying in the sun covered in factor 55!

    Could be way off as always!

    What does his rent payment clause say? The 'stay open' clause isn't an issue.

    Most rent a chair hairdressers that I know still pay rent if they go on holiday. Normally the owner goes on holiday but the salon remains open.
