DLA Reconsideration Turned Down

As title says I was turned down for DLA in early April so asked for a reconsideration, which I've just been notified - as of Monday - was also turned down (although they seem to have conceded I do have issues with mobility and care in this refusal letter, more so than the first refusal which basically claimed I was fit as a fiddle - ha!)

I got the GP care advisor to write and send off medical evidence on my behalf for the reconsideration but apparently she isn't able to help me with the tribunal stage so told me to phone the CAB, which I have done today and they are going to make an appointment for a proper advice session for me.

Mainly I was wondering if people could give me some words of wisdom as what I should do regarding the DWP, should I wait to be seen by the CAB before ringing them and telling them that I wish to appeal to the tribunal stage or should I ring up and lodge it now? I understand it has to be done in writing, if I do ring them will they ask me what I disagree with there and then and take that as my appeal or can I still make a written submission of what I am disputing? I presume the CAB can help me do this letter if I ask them?

Also, what paperwork is it good to request, I've read about a statement of reasons, is that like doctors reports etc? (They sent a gentleman from Atos to grill me despite me sending 20 pages of detailed info with the claim form) Do I have to ask for it all or does it all come with the tribunal pack anyway?

Latest refusal was dated 13th May, so have a little time to play with, I would rather get the wheels in motion before my head explodes, but equally don't want to rush things and make a mistake.

Any help would be appreciated, this is my first time on the merry go round, so to speak!

  • get the forms for an appeal,meanwhile see if you can get help from any of the following:cab,welfare rights.dial
    its better tbh to appeal from the start as part of the appeal process is a reconsideration

    Thanks, I didn't know they reviewed it then as well, was advised I had nothing to lose by going for reconsideration first. In hindsight it would have been better to ask for the tribunal straight away then, we live and learn :)
