Atos medical contradicts medical Atos?

I had an esa medical in october 2010.
scored 9 points and was found "fit for work with a return to work expected within 3 months"
I had another medical for industrial injuries disablement benefit last week and the report that I received yesterday contradicts the medical from october. I have the same conditions, will have for the rest of my life, and the results found that.. and yes i am aware that they are different benefits but the medical is the same procedure.
i have severe tissue damage, loss of 50% use of my neck, 70% loss of functioning in my back, severe left hand deformity, inability to reach hold and carry even the lightest of items with both hands, add to that fibromyalgia, chronic fatigue syndrome and a sleep apnea.
the report says that I am 50% disabled and shall remain it for the rest of my life.
not one of those things listed above was found on the atos medical report, but then again, with all the lies that were on it, im not suprised.
how on earth could the atos esa medical miss out on all of those things?
just gives more weight to the argument that they pass and fail who the hell they like.
i intend on writing to them to question this to see if this will allow them to overturn my appeal without tribunal.
altho i wont hold my breath.

That you and so many others have to deal with your condition and be forced into ridiculously unjust appraisals to get enough money to eat is astounding in our society.
The politicians have a much greater 'over-night' allowance per night
than the basic esa.:mad:
I read recently that 80% of those claiming esa are found fit for work.
So this means that our GP’s, the ones the government wishes to allocate funding choices to, are wrong most of the time.
So does the government wish to give them money to get them to find people fit for work according to their criteria, i.e. 20% of the time.
For myself I failed to get any points for an initial esa claim. My GP was told not to give me any sick notes, and to find me fit for work he apologised and showed me the email with this directive. So I had no medical support. and then almost got done for fraud for claiming jsa; due to the fact that they said I was obviously 'not fit for work'.
HOW RIDICULOUS!
I had to sign off jsa there and then, so no benefit at all for even longer.
I hope there are those who have their health can support and challenge this absurd situation. When you are poorly it seems too much to cope with.

It's something I come across on a daily basis. The majority of reports from Atos are unsatisfactory and some are downright appalling. It's as thought the Jobcentre Decision Makers are simply rubber stamping them whihc lo and behold results in under 15 points.
If you can get medical evidence yourself then you should always appeal. The Jobcentre MUST reconsider it before it actually goes to the Tribunal Service but to be honest there are few which are overturned at that stage.
The problem then is that appeals are taking many months because of the huge numbers the Tribunal Service is having to administer/hear. One chink of light is that at least claimants are able to remain on the assessment rate whilst the appeal is ongoing.
Remember you also have the right the complain to Medical Services about the assessment. Very few do which is a pity.I'll get you, my pretty, and your little dog too!0 -
Atos Origin are paid to remove a percentage off benefits - if they done this properly they would find themselves breaking their contract obligation. So indeed they are unfairly bullying people off benefits.
Labour modified the Jobseekers Act 1995 to allow disabled people to claim jobseekers allowance - which is cheaper to the taxpayer. This is the reason why they are attacking society's most vulnerable. This is clearly out of order.
You should appeal with the new medical results

Your GP should be working independently to help YOU and shouldn't be taking directions from others. If your GP gave into the pressure and deemed you fit for work (when you were not) etc. and almost getting you done for fraud then this is very unprofessional. If he does that to most of his patients then he should be struck off.0 -
Atos will try to claim the two medicals were different. But as you suspect the only difference is who is paying them, hence dwp atos fit for work, work atos unfit for work. They will swear blind they are different tests and argue till they turn green but they cannot escape the fact you are not the only one who has noticed this discrepancy.
Dodgy atos in my view, because disabled trying to hold down job with employer who doesnt want them are using these medicals to say you cant cope and then dwp are using them to say you are workshy, well not you personally but you get the gyst.
Do appeal the results and if they argue they are two different tests, ask them exactly how and dont accept the twaddle, how is asking a question re my mobility or illness or bending over going to be different between the two. Sad thing is this is getting disabled who want to work down, then labelled as unemployable then workshy by dwp.
Of course to some sick people the medical shows its time to leave work and they accept it but when do so dont need the kick from atos.

they were not different at all tho, the phsyical part of the medical is exactly the same. the only difference is that the guy was asking me the questions from a sheet and writing down my answers instead of the computer. that is the ONLY difference.
so again, it begs the question, how the hell can they find me this disabled and accept it here, but not for esa?

Re my GP? No didn't report, medically his hands were tied. He said I needed a sicknote and advised I find another GP, get the note and then move to another. He showed me the directive he recieved, 'MUST NOT' find her unfit for work, which I realize he should not have done. It wasn't till some months later I realised the directive had been sent to all GP's in my area. So the result was I had no medical support as the GP's that saw me felt I was unfit for work but could not proceed with the appropriate care as that meant documenting my condition.
Eventually a GP offered a sick note if I said I had depression, but then that would be all they could treat me for. I refused. In alot of pain and scared, I desperately wanted help with my presenting medical condition. I eventually begged a GP to see me without giving me a sick note if they would only help me medically. It took at least 9 months to achieve this.
Now I have one diagnosis and other tests ongoing. The GP states I am unfit for work.
Hopefully, the recent ATOS medical which found me fit for work will not cause such problems again.
I hope more people voice their experiences,
and gain strength from association.

Are you sure this directive was not just the standard you dont have to supply sick notes type of letter to a GP, if your sure it actually stated the GP cannot sign you of as unfit for work then can you obtain a copy of this directive?
Perhaps scan it (block out names/identifiable information etc) and post it up?
The DWP have no jurisdiction that I am aware of to enable them to dierct a GP to not sign someone of sick, nor in anyway stop a GP from giving medical care.
If this directive was worded as you say, the DWP could be in serious trouble if you can obtain proof of this and post it up...[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.

One medical used LIMA (the software the computer terminal is accessing) and the other medical used a human brain.[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
