Child Tax Credits Advice

When receiving my quarterly bank statement I noticed the last Tax Credit payment I received was back in March. I was aware I had an overpayment in 2009/2010 because of changing jobs (that year income was around £24,000.00) and had been paid £1000 more than I had initially thought. The total overpayment now stands at approximately £389.

I gave them a call to see why my payments had stopped (I had been expecting reduced payments). I was told that as we earned around £26,000.00 between us I am now only entitled to the basic tax credits of £10 per week and these will not be paid until the overpayment is payed in full. I asked would that change when we received our renewals pack and filled it in and he said no.

Last year up until March we had been receiving £90 per month. Our income itself is now £100 less than last year but he said that didn't matter we are still in "another bracket". I fall within the disabled category and had to cut down my hours at my consultants advice.

Have googled and received conflicting information so not sure what to think.

He did say he would get someone to phone me but it was unlikely they could do anything on our level of income!

An update really and looking for some advice.

We received our entitlement for this year and apparently are due no payments for this year. When reading over it I noticed that my disablement allowance was missing of it. Gave them a ring and was told I phoned them last Feb and told them I'm no longer disabled . I wish. I have scoliosis, dural ectasia, perniscous anemia and NF1 and receive MRC and HRM.

Was told it would take five days to make a decision. Don't understand this phone call business surely they have my NI number and could check which benefits I receive? Not very hopeful to receive anything at all.
