Have you spoken to neighbour or planning office? Who told you he didn't need planning permission?

He has also moved a shared drain and left me with some duck taped guttering piping leading to his new drain.
1 did you check your deeds to see who owned the fence, your neighbour may have owned the fence or thought he owned it .

Boundaries are notoriously difficult to prove. Sure, they are usually shown as a line on the plans that accompany the deed, but translating that line onto the ground is the difficult thing. Boundaries could have been moved, in the past. The position of the fence might not have marked the boundary accurately - the fence might have been placed in the wrong position years ago.
The Land Registry has a four-page factsheet about defining boundaries. You may need to engage the services of a Land Surveyor.Warning ..... I'm a peri-menopausal axe-wielding maniac

Got to say a big thank you to everyone.
The planning dept said a single story extension does not need planning permission.Although armed with all of the information that you guys have given me, I will be going back!
Planning permission said that boundries are not something that they deal with.They said this is a legal matter.
I do have a copy of the deeds, with the land boundries on..very difficult to transpose the plans to the back garden and decide about a 12" strip of land.It could be that the fence was in the wrong place?? But it looks like a 1970s style fence, so I would assume that the time involved would have claimed it as the official boundry (adverse possession@ 12 years??).What I can see is that the remainder of the fence shows that his new extension is 8" further over and in my garden!How much wider are foundations than the external walls??
Looking at the information the 2 metre rule is only for extensions more than 4 metres.I think it is just under..but will be checking!
I cant get to the side of my extension now for maintenance.It is six inches from mine.
I suppose on a positive note it will save me buying fence panels in the future.
Any solicitors out there want to write a letter to him?0
