Permitted Occupier Rights Help!!!

Hi all I do hope someone can help me with this asap please.

Long story but in short:- My boyfriend has a tenancy agreement in his name and i am a permitter occupier, I have 2 yorkshire terrior dogs the landland found out and said we could stay if he signed another 6 month tenancy agreement (even though the original agreement is for 12 months) and paid £695 as another deposit (cheque made payable to her!!) and agreed to pay in full for de-infestation of full house upon our departure. That is one issue
the next issue is that my boyfriend has dropped a bomb shell on me last night and said he is moving out and doesnt want anymore dealings with the property, as i pay all rents and bills anyway.

The landlady knows this and is asking my bf to email her to state that he wants to give up the tenancy, she says she might come to some agreement with me when he emails her the letter. Can you tell me what rights do i have? and she knows i want to stay in the house but if he signs to say he gives it up when can she get me out legally.

    It sounds as if you have the status of a lodger of your boyfriend, that does not allow you many rights at all.

    If your boyfriend gives up the tenancy then you must also leave at the same time.

    Since you already pay all the bills and rent it would make sense for your landlady to offer you the tenancy on surrender of the old one by your boyfriend, that way she does not even have a void period.

    I do not understand why she wants another deposit from your boyfriend, is the first deposit protected? If she accepts surrender then it will have to be repaid or used for damages. Then she would want a deposit from you.

    Would you pass the credit checks in your own right?

    I agree with her view about disinfestation of the property when the tenancy ends, dogs are smelly.

    If the LL did NOT de-infest the property, and the next tenants complained about, say, fleas, the landlady would, rightly, have a problem. And some VERY unhappy tenants.

    I'm sure YOU believe your dog is clean, does not smell, does not scratch furniture, and is well trained. But the risk to the LL is too great so she has to go to the expense of protecting the property and her next tenants. That expense gets passed on to you.

    I am named and included on the tenancy as a permitted occupier and would like to take over the tenancy, she has text me and said that as soon as my bf sends the letter of termination she adds ( I quote) "I will call you to discuss the matter further - it may be possible to come to some agreement with you"

    I need to know legally if she can get me to leave when my bf does please

    Yes she can, but why would she? She wants a rent-paying tenant in there asap. And she sems happy to discuss this with you.

    That does not give you any right. If would be same if you were no mentioned on the agreement at all.
    Basically you are a guest of the tenant. When the tenancy ends you have to vacate or become essentially a squatter.

    I assume that you mean that the landlord asked to increase the deposit by an extra £695.
    I don't see the issue with the cheque being payable to her. Who else should it be payable to?

    Perhaps you pay the rent, but he is liable for it as he is the tenant.

    I don't see why the landlord would not accept to agree a new tenancy with you.
  • Be very careful about your deposit(s) it sounds like you have paid them and the BF(ex) may be the one getting them back!

    It sounds to me as though the LL fancies ending the agreement with exBF, then kicking you out, and keeping all the deposit money for cleaning and 2 months rent in lieu of notice after the exBF leaves.

    Her "may be able to come to an agreement" could well be that you stay, but not your dogs.

    Be very careful
    Unless it is damaged or discontinued - ignore any discount of over 25%
