Real or fake - Who decides?

I recently sold a Houbigant fragrance on eBay, Genuine as it was a competition prize from them!
The seller has decided it's fake and arrived damaged, despite signing the S/D form and put in an eBay claim who in turn have put a hold on the payment, Leaving me with a negative paypal balance :mad:
As it's been damaged I've offered the buyer a refund on return but who decides whether the item is fake? The Buyer? The Seller? or Paypal?
Also with a negative balance due to the payment on hold am i able to use P/P as payment without first clearing the balance?
Ebay and paypal, conspiring against people to cause a headache in my opinion! Have no problem providing the refund but the buyers reckons pictures should be adequate to substantiate the claim - The muppet! :eek:

With an ebay claim you have to prove authenticity, the letter from the comp should be proof.
What does she want the photos to prove? If it;s that the bottle was broken then that should be enough to get a full refund.0 -

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
If you have offered a refund on return due to its fault then you don't need to worry about who says its a fake unless buyer has put it as a fake in their claim in which case they will have to prove this to paypal by getting a letter authenticating it is fake from a stockists
If it resalable maybe put a copy of the winning letter you got with it to avoid this again0 -
I bought a dvd on ebay that turned out to be counterfeit. despite correspondance and evidence with both ebay and paypal nothing was done to compensate me. They said it was a case of my word against theirs.. since then have never bought cd or dvd on ebayWhat Would Bill Buchanan Do?0
