    Thanks for your help IJ, I dont live in the area anymore and I'm not on the electroral roll any more. My ex wife put a line through my name last time the forms were sent round. Its possible that my previous tenant put our names onto the form in order to stop the council tax chasing him?

    Whilst I think you should have gone to court & contested it in the first place a warrant which is obtained based upon incorrect information may well still be found invalid. I suggest you contact Consumer Focus and / or a solicitor & the local court for urgent help in trying to get this warrant struck out.

    Ultimately you don't have to prove anything to British Gas it is they that will need to prove that you owe the money. If you do pay up but, if you don't, don't be bullied into paying someone else debt, just take it to the Courts!

    Quick update:

    BG are again looking into the matter thanks to the BG representative who posted on this thread.

    With regard to the warrant, it can only be executed on the date stated. As they didnt come yesterday this makes the warrant invalid and they have to go back to court to get another warrant and start the whole process again. So it appears my ex wife won't be getting the door stoved in after all. After I wasted a day sat in the house waiting to let them in.

    Not sure where you got that information but I suspect that's not necessarily correct. A warrant is normally valid for 28 days. I suggest you request a copy from BG and / or the court & get some advice urgently

    I got the info from BG themselves, in an email. To quote them directly:

    On a very general note I can say that warrants are for a specific day, so if yours was for yesterday and did not happen we cannot come out under a warrant without going through a full court process again, which you will be notified about

    Not sure who wrote that but as I said above you need to check this - preferably with someone legally qualified. Have a look at the link below

    "Rights of Entry (Gas and Electricity Boards) Act 1954

    F8(4)Every warrant granted under this section shall continue in force until—
    (a)the time when the purpose for which the entry is required is satisfied; or
    (b)the end of the period of 28 days beginning with the day on which the warrant was granted, whichever is the earlier.]"

  • Just an update, someone who seems quite on the ball at BG is looking into this, although they continue to call me with recorded messages asking me to contact them! Nothing has been disconnected still.

    Think the bg person does not know about warrants, the warrants under the rights of entry act are valid for 28 days, but they can only use it once and they have to give notice when its been executed.

    If rented out, did you declare the rent on a tax return and have landlords insurance this can show as proof.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
