Can I have a default removed from my credit file?

  • If you wanted a good nights sleep you shouldn't have fraudulently used credit in return for goods with no intention of paying the debt off.

    Maybe when you start making credit applications again they'll notice the discrepancy and place a fraud marker on your file, preventing you from getting anymore credit.

    Sorry that you disagree, but "being a kid" doesn't negate any responsibility.

    It's like killing your dog and justifying it by saying "I was only a kid"!

    A bit of an extreme example, I agree, but relevant non-the-less.

    Please note the following to remove your default and possible gain compensation.

    1) It is illegal to provide credit to under 18 year olds, despite your fraudulent actions gaining credit the finance company had a duty to ensure you were who you said you were and old enough to sign the credit form. They had no legal right to collect any money and were negligent in their duty.
    2) The contract between yourself and the credit company never existed and they cannot therefore leave any information regarding that account with a credit reference agency.
    3) The default is illegal as no contract existed and therefore can be removed
    4) The finance company have commited a far greater offence than you have and would not wish to pursue this, you may well be entitled to compensation from the finance company for the false information left about you with the CRA and the illegal default action taken.

    As someone who has worked for 3 finance companies giving credit to the public directly and working as a loan collector and debt collector I feel it's very likely that you can get all the money you have paid off the loan back along with compensation.
    What you did was wrong but you were just 15, the finance company should know better and they are still giving credit to the public and as far as we know some 15 year olds.

    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

  • Thanks for the help from those that offered it, I'm sorry that the rest of you would rather condemn than forgive.
    The default was removed from my credit file 2 months ago and I'm now free to get on with my life.
