    Parcelforce did not say that the parcel was incorrectly declared, HMRC did that and you can appeal to them within 30 days of receiving your parcel if you think that you have been incorrectly charged and they will 9 times out of 10 overturn the decision and give you a cheque for the refund then the clearance fee gets refunded also.
    you can request a breakdown of the bill from parcelforce by contacting us, this is your right under the consumer credit act 1974

    and tandymalbot. finally like a child you will obviously never listen to anyone if you think you are right. why not try not putting a stamp on a letter to see if rm deliver it. it will either be held in lien or rts as there is a deficit of 1.5m each year for unpaid postage. read the postal services act again under section 89 and you will see that for outstanding payments post can be delayed, again we are not post but we are courier. do all rm services have to abide by postal services act??? what about broadband services, moneygram and all of the other services rm provides? this is like saying virgin rail has to abide by the credit card financial services act or the internet service providers terms and conditions. many compnies cover different services which are not all the same type of service. Royalmail mail group plc is an umberella corporation which covers a lot of individual companies within it. so nect you will be saying that the person who runs the passport section of royalmail is also bound by the same laws as the person who sorts mail at your local sorting office. Think about it , just because you are not happy with the service does not make you a corporate lawyer who knows the ins and outs of the law.
    By the way, i studied a degree in law so i do know the legalities of this argument and i know that this is why the case which globaluk was bringing against Parcelforce, was dropped by the crown prosecution service for insufficient evedence

    Milesy if you think you have overcharged by customs, you probably have been,
    it worked out as 15% of the declared value and the courier fee and any insurance paid. Don't ask me why they charge vat on the courier costs when even Parcelforce do not charge vat on any service but they do, and i also don't think that is right for them to be able to do that but that is a different matter. look at one of my previous posts for the telephone number for hmrc and keep trying because they are very busy and i'll lay odds that you are entitled to a refund but will not guarantee it. when i get to work, i will post the mailing adress to appeal for customs appeals. you can still appeal up to 30 days later. by mail, you will have to include the red and white customs label and a letter to outline your appeal. also if it just says "clothes" or "electrical goods" on the customs declaration form this may be why they have been incorrectly charged as the items have to individually itemised and priced(a breakdown of the contents) then totalled

    Evil Ed. I am not trolling here or trying to offend you but I think you have a problem reading what I have posted. Please read it again properly.

    I stated quite clearly I have no problem with the customs duty, as I expect to pay tax on goods from outside the EU - this is fair, and fair money into our country's chest.

    I only think the PARCELFORCE CLEARANCE FEE is out of order. I can almost bet the "admin costs" involved for each package is not £8. I find it very hard to believe that the parcelforce driver goes to customs to pick up one package at a time. They will pick up parcels in BULK, and do admin work in BULK. So if one shipment comes with 100 items, then parcelforce had to fork out £800 in one go in admin costs ? Come on... give us all a break. We remember what happened when the banks said their fees was to cover admin costs!

    Once again, just to put aside doubt.

    Customs "Duty" = GOOD
    Parcelforce "Fee" = BAD

    Notice the emphasis on the words DUTY and FEE there.

    I am quite worried about you now. Where are you getting this information from??? I never at ANY TIME stated that ANYTHING was incorrectly declared.

    include the red and white label provided by HMRC and a cover letter outlining your appeal

    the sender may have incorrectly declared the value of the item on their commercial invoices which are supplied by the company or person sending the parcel. these invoices are not available to you because they are retained by customs in the sending country and by customs in the uk. you as the recipient have not declared anything to customs.

    Section 89 says no such thing. Parcelfarce the so called courier company are the only 'couriers' I know that deliberately delays the delivery of mail by holding it until all charges are paid. This is illegal. I don't use Parcelfarce anymore since if I buy from the States etc it can take two days for my shipment to arrive in the UK and then up to a week for the boneheads at Parcelfarce to invoice and deliver and charge £13 for the privilege:rotfl:

    The other couriers will invoice for the VAT etc, if you don't pay it then they can recover it from you as a civil debt, but these couriers do not break the law by holding your goods until the charges are paid a la Parcelfarce.

    Charges aside I don't know why anyone uses Parcelfarce these days, the prices are a total rip off compared to many of the services available from the courier brokers. Each to their own but I prefer not to flush my money down the toilet and get a pants service into the bargain:naughty:
  • The more I think about it the more I think the new poster Evil Ed is someone at Royal Mail deliberately posting misinformation. They are aware that I am posting here because I told them as much. He says he knows that the CPS apparently dropped the public prosecution from the original poster. That's not something someone in their call centre is likely to know
