holiday insurance will not pay

My son was returning from his holiday in Ibetha. On the way to the airport he parked his hire car in a car park and spent some time on the beach, he had locked the car before leaving it. On returning to the car all his and his girlfreinds luggage had been stolen, but the car was undamaged. On contacting the police they told him that a gang was operating locally, using a scanner which picked up the locking code for the car and using the code to open the car after the tourists had gone to the beach. They provided him with a letter that stated that this was the most likely form of entry, because they had information that this type of crime was prevalent in the area. He contacted the holiday insurers when he got back and gave them this information, but they refuse to pay out as force was not used to enter the car. I would have thought that with the written information from the police he would be able to make a claim. As he locked the car before leaving it and not being made aware of the likelehood of this type of breakin I think he took reasonable care to protect his belongings, so why wont they pay?

    I think "forcible entry" is a standard clause so as far as the insurance company is concerned they don't have to pay.

    Having said that the FOS have a "treat the punter fairly" ethos which means they can apply a fair interpretation rather than the strict legal meaning on terms & conditions which, in my view would mean they would rule in your favour.

    Complain to the insurance company and if they don't play ball take it to the FOS
