Time off for medical appts- pre-existing conditions?

My partner had a breakdown in Feb of this year, his employers are aware of it and have ensured his life at work is as unpleasant as possible- will post full saga another time as a few issues there.

He's been seeing our GP regularly and a psychiatrist, he's always taken annual leave for these and was made to for the period of time he was signed off sick for.

He has no annual leave remaining now.

He feels he's heading in a very fast, downward spiral again and is trying to get into see our GP to get his meds reviewed, unfortunately, his employer will not allow him to take time off even unpaid to do so.

He's offered to make up time but again, this is rebuffed.

He works 8am-6pm and they won't allow him to come in later so he can get a first thing appointment. He works an hour away from home, so he would need extra time (which he is willing to make up) to get there and back in a lunch hour, which as before, they aren't willing to let him have.

Any other strategies he can try, he doesn't want to go AWOL.

    Are you saying that he was made to use up his annual leave for the time he was signed off sick? He got holiday pay instead of sick pay?

    He was told he wasn't eligible for SSP and the company do not have their own sick pay policy. He was given 2 weeks off by our GP who wanted to review after that.

    I was told he could either have unpaid time off or use annual leave, he chose the latter.

    Thats an interesting one!!

    He worked for them for 4 years until September 2010, when the bosses wound the company up and made everyone redundant.

    They reformed the company under a slightly different name in December 2010 and he's worked with them since the middle of Dec.

    So officially if he has been made redundant he has only been there for 5/6 months under the new employment which when he went ill was only what 10-12 weeks into the new employment which is why he may not have been entitled to SSP.

    I think that was what was implied at the time but doesn't really answer my question above as to whether he can take time off unpaid or offer to make up time as either one is rejected by his bosses.

    There is no right to time off work here at all, with or without pay. And no right to time off even if he later makes it up. It's extremely unusual to find an employer this intransigent on the point, but technically the employer is absolutely correct on all points - although I am not sure about the SSP part of it. But if there is no entitlement to sick pay then yes, it would be unpaid or holiday. And there is no right to time off for medical appointments.

    What is the rest of the story - because this does appear to be an incomprehensible attitude for the employer, and perhaps more information would give us a route in to some useful advice.

    PS - Just had a look and as far as I can see SSP is paid unless he has already claimed his maximum entitlement. Why couldn't he get SSP?

    Providing he earns on average over £102 a week then he should have been paid SSP. If they couldn't/wouldn't pay SSP then they should've given him a SSP1 form stating why they wouldn't pay SSP which he could then use to claim Employment Support Allowance.
    Then presumably he'd have enough A/L left to take in order to attend hospital appointments.

    I think he needs to speak to his employers and if it cannot be settled he can speak to the HMRC.
