Then surely they would have commenced legal action, rather than sending daft fishing letters time after time after time?
You make a very good point. I have a CCJ from about 5 years ago, in which the company involved wasted no time in getting. Which ties in with what you have also said king, about the 35% discount? Its not until you actually go through what these letters are saying that its doesn't quite add up. Also, I guess if it was still enforceable then they would not be willing to accept a 35% reduced amount as full and final payment?
Righto, I have fired off the second SB letter and will post recorded delivery on the school run this afternoon.
Thanks for your advice today guys, I will keep you posted.

Well, in that case, let's just hope you were wrong when you said you were paying this up until you moved out in Dec 2005.
If you were paying this until Dec 2005, then it wouldn't be statute barred until Dec 2011.
I think you misconstrued what I meant.
I would still say it's safer to wait.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Sounds to me, that in perhaps just a short while that you will be able to be confident that the debt is barred if it's yours?
And by that I meant in December.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Oh I think I must've misunderstood. By some chance I left the house in such a rush, I forgot the letter. I shall leave it for now and then maybe respond when I inevitably get another letter.0

Hey just thought I'de throw my tuppence in.
I have also been getting letters from AK which started out as 'fishing' letters, but put the amount owed.
The debt I owed was going back to 2003, which I initially was paying but I think the last payment I made was around the 2005/2006 mark, definitely not after March 2006. So still not sure if SB, however I have moved a few times since and they always seem to find me. The last time (last year) they started the letters and and when through the same channels of offering discounts the most significant discount offer was20%of the original debt.. so thats considerable and maybe an indication that the debt is SB and they are trying to get anything they can.
I have not responded to any of their letters and they have 'changed companies) and its at the stage where they have threatened to send 'field agents' again.
Its all rather tedious, so just wanted to let you know the situation as they tend to follow the same route. I'll post what they do next, I'm certain they wont send anyone and if they do so what? Whats going to happen?
If they could legally get the debt they would have gone through the courts already and it could have been enforced but I believe they can not.
Let me know where you guys are with yours.

My father in law has received a letter from activ kapital claiming he owes them nearly £2000 on a debt from a company called Lewis (presuming this is John Lewis). However, he has never had a credit card from this company. So could not have run Up such amounts of debt. I have read through posts suggesting writing to them but in this specific letter is says because the previous company had a ccj against him, they do not have to provide any documentation for this debt. I am unsure how old the debt is...but if it's over six years old does it mean he doesn't have to pay (considering it isn't his debt)? I'm getting quite worried now as they say after 28 days they will send bailiffs around. He is an oap on pension...how he is meant to even start affording to repay this is beyond me. Any suggestions will be gratefully received. Thanks
