Redundancy due to location change - any help appreciated

collective redundancy consultation has just finished and I've been told that my last working day is 7th October as this is the last day my role exists at its current location. Agreement during the consulation period was generally that those employees taking redundancy would be expected to work half of their notice period and get the other half paid in lieu - my notice period is 4 months.

I'm now being told that I'm expected to work up until 7th October and the two months will be lumped into an 'enhanced redundancy' payment.

I understand that usually, the notice period begins directly after the consultation period ends on the trigger of the formal presentation of the terminataion date, which has just happened - but this doesn't legally have to be the case. Can anybody help? My expectation was that I'd work two months from the end of the consultation period and then leave, but now I'm being told I have to work 4.5 months..

    personally I'd be happy getting the extra months' pay - they do need people to run the site, do you have anything else lined up?

    There's no legal requirement for any pay "in lieu of notice" at all btw, so what they are doing is ok, legally.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    A company can give any notice they like above the statutory/contactual minimum.

    They can set any date in the future, conveniently the 2 months should be paid gross since you will have worked more than you full notice anyway.

    Handy if the main payout is below £30K less so(only NI saviing) if not.
  • thanks both, thought what you're saying was probably the case; guess I'm just having trouble adjusting from my initial expectations!

    Nothing else lined up yet, was just thinking about taking the summer off :)
