    The deterrant effect of cctv is almost non existant these days, and there is nothing at all stopping you from recording as a householder your own cctv footage, the DPA specifically allows it.

    Signage for domestic use will make no difference to whether evidence can be presented as evidence, and is if anything more likely to make any existing problem worse, as the signs will alert people to the cameras.

    It is not for the police to decide anything.

    It the for the crown prosecution service to consider the evidence and ultimately for the courts to decide whether evidence is admissible or not.
    It may be that there is already 'case law' on whether such evidence is admissible or not - though as usual I'd expect it will 'depend on the circumstances'...

    After fiddling with CCTV etc, we have been unable to get it to set up as we would like, but the police are now more involved and are organising a mediation session. Landlord is now taking it seriously, I think since a relative of his was subjected to abuse! Suddenly he seems to believe my friend's side of events, they have a diary including all reports logged with police, evidence of other harrassment e.g. letters to council & environmental health, all with the replies stating no case to answer. He visited both properties last week and was shown the dossier and appeared visibly shocked that there was so much of it! His actual response was "who the h**l do they think they are, carrying on like this"

    So the mediation will occur, landlord is going to be involved and hopefully this will sort things. Am very hopeful that this can be sorted out one way or the other.

    As you've probably guessed, it's a neighbour dispute - started over parking but has now progressed. Police just say 'talk to each other' which does nothing, and landlord (same one for both properties) refuses to get involved.

    It is not my property, but my friends don't know what to do next..

  • I have just gone through this with the police/local authority. Your neighbour can put up cctv cameras and film anything he likes "for personal use" and there isn't a thing you can do about it - doesn't matter if you have children playing in your garden or not. He doesn't have to put up a sign or tell you about it. He can also film the street including anything you do. Now to me, "personal use" could mean filming someone's kids because you're a pervert and sharing them with your friends, do you not agree?

    In my case, he is the one harassing me. The police are worse than useless. They say it's a civil matter. I have asked them about my human rights, etc but they don't wanna know. His cameras are pointing across the street at my house.

    I checked with a solicitor and he advised an injunction. No word on costs yet though, I'm still investigating. If anyone has any idea of this, please post!

    Police say that for anything to be used in evidence in court against your neighbour it would have to be absolutely spot on. They would practically have to see the whites of your eyes on the film and show you damaging property, etc. They say that most people can't afford the type of system that would enable this. Somehow I don't believe them.

    Most CCTV systems do not meet the requirements to be used as evidence - theu're used as information leading to the gathering of evidence, eg to identify an individual who is then visited and found with stolen property in his home.

    But a reasonably good megapixel IP camera starts around £500 (and has onboard recording so a video recorder isn't required) and would provide much better results than most of the cheap camera+DVR packages.
    A kind word lasts a minute, a skelped erse is sair for a day.
