ive asked a few times for help on here but dont get a reply?

im sorry but i have recently asked for some advice from people in the know but for some reason people look at my post but no one replies.:(

I dont know the reason for this but im not credit report savvy and as i am trying to rebuild my report i need some help. Please please help me, i have a problem.

from my previous posts i had a credit card from capital one that was partially settled last year and i have a letter from capquest and capital one proving this.
I wrote to them and asked them to update my file which they did and also removed the default from my file which was great.

However, i get home and theres a letter from Cabot financial saying that i owe this money to capital one and the debt has been sold to them. I phone Cabot and tell them it was settled, they ask that i send them a copy of the letters i have which i did yesterday.
I check my Equifax report today and Cabot financial have now put the default back on my report under their name, for the same amount.

Please help, I dont know what to do. Can they do this, if the default had already been removed from Capital one??

Any help at all is appreciated, even just an 'I dont know?'

    I don't know what the right thing to do is either, I'm afraid but I think what I would do is sit tight for a few days and see if Cahoot get back to you after they've seen the letters you've sent them, and what they say. If they say "sorry, our mistake" then fantastic but if they continue to peruse the debt, you could dispute the debt by asking to see the CCA (I think that's how it works, I've never had to do this).

    I hope I've been some help and I hope someone comes along to give a bit more advice soon!

    You do not pay twice, cabot will have to update their records and if they don't you can take them to court i think, its classed as malicious if someone files wrong credit against you and won't remove it.

    I didn't want to read and run, but not sure the best way to go. Would the prove it letter from them get you anywhere.
    Overdraft = £1000 Emergency fund = £2500
    Competition wins 2015 = £1400

    What exactly does the original letter from cabot and capital one say? For example, if it says the amount you paid was "as a full and final settlement" or words similar to that, then you can tell cr*pquest to go away. If it doesn't, you may then have to send the prove it letter to cr*pquest to see if they can prove you owe the debt. I've never heard of anyone getting a default removed before, but I'd deal with the money situation first.

    thanks very much for the replies.
    the original debt was for £365 (most of which was charges). I agreed with them to pay a partial settlement of 3 instalments of £57 which i paid. The outstanding balance is £171.
    THats what Capital one had one my default on my report and its the same amount thats on there now from cabot.
    The only difference is the old said it was a default from capital one and now this one says its a default from Cabot.

    Ill look out the letter i have from capital one and capquest and post it x

    if you have a letter saying it is settled then cabot will have to remove their default or mark it as settled

    Thank you for writing to us about your account. I can confirm your account with us is partially settled with a balance of £171.67 and we are not pursuing you for any payments.


    CAPQUEST LETTER:
    Thank you for your payment. I can confirm your account is now settled and closed. As the amount you paid to settle your account was less than the full outstanding balance, your credit file will show as the balance is satisfied with a special flag of partial settlement.

    CABOT LETTER
    CABOT has recently bought the account you held with Capital ONe and we're now responsible for receiving your payments, handling your queries etc (outstanding balance £171.67)

    Hi Vintagegirl,

    The letters seem fine from capital one and cabot. Cr*pquest are chancers and feel free to tell them to go away, although I'd be inclined to send the prove it letter to them as I bet they can't prove you owe the money. You could however remind the idiots that you have copies about the debt being settled and send them a copy. Keep copies of those letters carefully as they could be handy in the future when some other pond life try to get more money from you.
