im curious how could this backfire?
There are three main problems with legacies to charities, which have been touched on. In summary:
    1. If you leave eg £1000 but there isn't £1000 ready cash available in the estate, the charity may push for executors to make the payment before assets have been realised and suggest a loan is taken out.
    2. If you leave 10% of the estate to a charity, and £1000 to each of Peter, Paul and Mary, then that relies on the estate being worth enough to make all the bequests in full. If at the time of death the deceased is renting their home, has nothing of value to sell, and only £3000 in the bank, then the charity gets £300, but P, P and M can't have £1000 each.
    3. And again, if a % has been left, the trustees of the charity may push for the estate to be settled at a faster pace than the executors can reasonably manage.
I have said before that the trustees do have a legal duty to rake in money which has been left to them, however there are ways and ways ...

  • I'm looking for someone to write a will for my mother (82 years old!). Just go to a local solicitor. Phone a few and ask the price for a basic will. Around here it is is £125 minimum if done by a solicitor. Some of the online sites are good and can be checked by a solicitor and be cheaper than getting your local solicitor to do it. They do charge a bit much for a basic will since it can all be done online - it's all very standardised. I am looking for a local will making firm which should be cheaper. I need a slightly different will maybe a trust will so I can't do it online.

I don't see how the OP's Mum can get a will 'for cheap', given the information about assets in 2 countries, the language difficulty etc.

If it is done cheaply now it is likely to be expensive in the future following her decease. I've been told that most expensive legal work carried out by solicitors in connection with wills is if the will was done cheaply and incorrectly in the first place.

As Mother is only 55/56 there is also plenty of time for the prodigal sons to mend their ways long before your mother dies, she might change her mind on this excluding them from the will thing.

    very good advice
£200 is a rip off they the good ones that is will keep it for free
I think they will only keep it 'for free' if they have charged you to write the will and/or will charge you (even more!) for being an executor.

HM Courts will keep it for ever for £15. That is a bargain.

We've just re-done our wills. £120 for 2, and they are stored in the solicitor's premises.
